When a prospective employer does a background check will my lawsuit against workers comp/employer for medical show up:
I applied for a new job and the company is doing a background check. I had a lawsuit against workers comp/my employer to pay the medical bills I incurred after workers comp released me from care for a workplace injury. I am wondering if that will show up on my background check

David’s answer: It is very unlikely that the new employer will find out unless you tell them about the prior workers comp. case.

Do I have a case of negligence?: I was injured on the job at a customer site by a forklift driver moving a stack of 4 racks when they are only supposed to move 2 at a time. I was not in what would be considered the "danger area" while the lift was taking place. I sustained a cut to the back of my head and could have been killed if I had been even a foot to the right or left. My employer expects me to return to work as soon as I'm healed, but I am having issues with PTSD after the incident, and I'm not sure I could do my job again without constantly being scared.
David’s answer: Michigan is an exclusive remedy State, therefore your exclusive remedy against your employer is under Workers Comp. law. If you were injured by someone other than a co-employee or someone with your company you may have a negligence case, if you can prove negligence. Workers Comp. on the other hand is no fault.
