I have a friend that told me he violated his probation in 2011 and has not yet turned himself in. What will happen.: It was a charge of driving on revoked license and small marijuana charge.
Taurus’s answer: Criminal law matters are handled differently in different jurisdictions and by different judges. In all likelihood he will have to pay some kind of fine, But it is very likely that he will also be taken into custody. He may have to make a bond unless he is prepared to resolve the case on the spot, Perhaps plead guilty and pay fines or fees upfront. Often in order to get cases off of the docket the prosecutors may agree to this. Remember though, all matters must be accepted by the judge.
My lawyer assures that I will be granted diversion if I enter a guilty plea. is this a foolish decision?:

Taurus’s answer: In Tennessee criminal law, diversion may be agreed upon by both sides, however if it is judicial diversion then the judge must approve it. That doesn't main that the likelihood of receiving diversion is any smaller or greater. This is just the proper procedure. If your lawyer feels confident that you will receive diversion then in all likelihood you will receive diversion probation however judges must always approve it.
I have a theft under $500 . it was one item worth less than $100 from walmart. no other theft history on record. will i get jail: stole but didn't make it out of store with a vacuum cleaner from wal-mart. no fuss no fight. had a bogus receipt not for the vacuum to use as receipt for said vacuum.
Taurus’s answer: Because you do not have a prior record, you may be able to work out a merchants diversion agreement with Wal Mart, pay them double the amount of the item, and have your lawyer ask the State if they will dismiss the charge. This not guaranteed however. There are many alternatives. I'm a criminal lawyer in Memphis, TN but the rules are likely the same there. You should speak with a lawyer in your community about a dismissal or probation possibility.
