What happens now?: The cops ripped me out of my car due to being asleep and citing drugs. I wouldn't let them search it, it isn't mycar, so they took it to search at their location

Scott’s answer: The police will apply for a search warrant. If the judge signs it, they will search the car. After they are done they will return the car to the owner. If they find anything in the car, both you and possibly your friend, will need to get an attorney. Any challenges to the legality of removing you from the car and seizure of the car will need to be litigated after charges are filed.

I had a female in her 20’s that decided it would make her look like a badass if she took a branch the size of a baseball bat and tried to take a swing at my head but she missed , as I was steadying myself she can down with that branch onto my left hand flattening my thumb and first two fingers , my rings had to be cut off at the er. I have rheumatoid arthritis ,it’s so bad in my hands that they were having trouble reading the X-rays. I also have high blood pressure, a serious heart condition with a previous heart attack that went untreated. There was a witness that saw her going up to where I was, and her boyfriend was within hearing distance , possibly visual, he started calling me ‘a cop calling b*tch’ , then proceeded to go hide before the cops arrived. I did a video statement plus 3-4 verbal. When they arrived with the emts
I was paraded into the parking lot of a nearby buisness. They let trainees do the investigating who said they couldn’t figure out what happened because the other female was lying and saying I came after her. They didn’t arrest her, they didn’t even do a book and release.

Scott’s answer: What are you looking for in a response? It's very possible that the prosecutor will review the reports and file criminal charges. You can contact the prosecutor's office to ask what is going on with the case. You may also have a good personal injury suit as this is clearly negligent and you suffered injuries. The bigger question will be whether or not this person has any assets you can go after if you win. It's probably worth a consultation with a personal injury lawyer.

If I explain an attempted murder on me to certain officials will it be up to me to press charges?: I was almost killed by someone in my household via arsenic and mercury because he had a psychotic break. He talked abii look it he thought that the government could be sending me to kill him it was concerning and I spoke to another family member we couldn’t come up with a good plan by the time things got worse. Around the time he started talking like that I got really sick after eating my food I had a blood pressure reading of 155/138 and that’s when it was somewhat moderate. I almost had a heart attack multiple times and couldn’t feel my body at all. It was hard to breathe. I don’t want this person to go to jail because I need him to sell the property that grandma gifted me that’s in his name currently. That 100,000 is going to help me for survival. Plus I just couldn’t have it rest on my mind if he were to pass asst in the prison system because of his health conditions as he’s older now. I need to reach out to a forensics laboratory to get certain items tested but the ones he found are state patrol and also WA crime labs. If they talk to the county police will it be possible for me to have the final say if it’s pursued? Thanks.

Scott’s answer: If the government has evidence that a person committed a crime the decision of whether or not to prosecute that person is entirely the prosecutors to make.
