I have recently found out i have a federal detainer on child indencey back in '08 this has to be a mistake or identity theft.: What does that mean i allegedly did?

Brian’s answer: I have practiced criminal law for over 10 years and have never seen an identity error of this type. There must be more to this story. I strongly suggest you retain legal counsel asap. Federal sex crimes are prosecuted VERY aggressively. We handle these matters all the time and I would be glad to discuss the finer details in private and explain the process.

The good news is that if this really is a matter of mistaken identity, you may have a very good defense.

If I was a betting man, I would bet your name popped up as an account holder of an internet account that was linked to some kind of internet child offense. Such cases are very common and it is not impossible for investigators to target the wrong person (the account holder versus another person who has access to the computer and does something illegal with it - like a roommate).

Anyway, call me if you would like a free initial consultation.

Do I need a federal criminal defense attorney?: BATFE agents approached me at my house to inform me that a guy I have privately sold a few handguns to has been trying to smuggle the guns into Puerto Rico. They took a recorded statement after telling me not to hire a lawyer. They said I've been straw purchasing even though I never went and bought a gun for anyone but myself. They want to place me with an undercover agent to make another sell to catch him. One agent told my family that they're not interested in me since I have no criminal history and they just need my help but the other agent has made statements on whether they decide to file charges in the future or not. I want to help but knowing now who these people are I'm worried about what could happen to me in prison once they know I'm the reason they got caught.

Brian’s answer: Absolutely YES you need a lawyer ASAP. The agents are lying to you because it is easier for them than to deal with a lawyer. The CORRECT way to cooperate is through the US Attorneys Office where an immunity agreement is signed in advance. Also, the US Atty has to answer honestly when a defense lawyer asks them if the client is a "target" or merely a "witness". PLUS, if you do get prosecuted later for straw man purchases, you want ALL of your cooperation on the record. Without a lawyer on your side you, you are placing your fate in the hands of the agents - some of whom are corrupt but are not all bad.

The simple answer is that they told you not to get a lawyer because it means more work for them and is a pain in their ass... But it PROTECTS you!

Do not be foolish... Hire a lawyer ASAP!

I have been a criminal attorney for over 11 years and represent people in Federal cooperation matters all the time... Including many high profile cases.

Brian’s answer: I am a Florida injury lawyer. First, you need to take care of your injuries and see a doctor to make sure it doesn't worsen. Second, it sounds like you may have a good case, especially if you now have a chronic problem.

Have you had an x-ray or an MRI? You may have fractured your bone. We will need doctors to evaluate you and see what is really going on under the skin.
