I have chronic arthritis pain in hands, knees, lower back and hips. I was also diagnosed with Parkinson's 4 and a half years: Been having cognitive issues for a year. Went from good reviews to probation. Would I qualify for disability ? I live in FL.

So my friendo applied for 2 credits card from furniture stores she is intending to rack up and not pay? Will she be prosecuted?: Basically she has excellent credit and now she is going to spend all limits and just make the 1st 2'payments and just stopped paying. She is intending to max out more that. 30 thousand in credit from furniture stores and visa and MasterCard.

Eric’s answer: Your friend is a very dishonest person. Any time you purchase something with a credit card and don't intend to pay it you are committing credit card fraud and theft. Even if she files bankruptcy the credit card company will closely examine her account for evidence of fraud. If they can prove to the bankruptcy judge that she never intended to pay or that she should have known that she would never be able to pay, the judge will exclude the debt from bankruptcy. And yes, she can be prosecuted because credit card fraud is a crime.

Automatic Stay to Stop Home Sale Date - Chapter 7: What happens if I file a Ch7 and my home is scheduled to be sold a few days later?

Will the filing stop the sale immediately?

What if the Ch7 gets rejected a month later and I do not want to do a Ch 13?

What if I do not want to keep the house but I can not move before the current sale date?

Can I change my mind about keeping the house during my bankruptcy?

Eric’s answer: Stop Foreclosure Sale with Ch. 7. Yes, as long as you have a bankruptcy case number before the sale, and notify the clerk, the sale will be stopped. Don't wait until the last minute though. A chapter 7 usually last about 3 months. Unless the mortgage company asks permission to proceed with the foreclosure, the cannot. After the bankruptcy, all you could do is go to the foreclosure hearing and ask for more time to get out of the house. If you never filed an answer to the foreclosure, you might not get a notice of that hearing. Is sounds like you really don't want the house, but don't want to move. You have a lot of balls in the air. How good of a juggler are you?
