What rights do i have as a married father to see my child: Trying to figure out whats right do i have to see my daughter, i have always provided for her and have documentation to prove that. Does father have rights to visitation and custody? Children born out of wedlock, married later, now seeking divorce.: We have 2 children born out of wedlock. We married a year after the last child was born, and were separated a year after our marriage. I am currently seeking divorce. Due to father being abusive, alcoholic, and illegal drug use I chose to keep the kids away as much as possible. I know he is the legal father through marriage, but would he still need to petition through a court for visitation and custody if he argues that I (quote from him) ‘kidnapped’ the children and denied him visitation?

The short answer is that yes, he would have to file suit against you alleging all of those things. You would likely respond by denying them and justifying your actions, and you would likely also demand the same relief. Your case would necessarily go to mediation, as a Georgia custody case, and a skilled mediator would work out cooperating child custody schedules for almost every contingency.
