Can they reinstate probation?: I'm in Georgia and over 6 years ago I was accidentally discharged from a 10 year probation sentence. They've just found their mistake and want to reinstate my probation, can they do this? Should I ask for a hearing? I've been in no trouble during this time, not even a traffic citation.
Bert’s answer: The answer depends on whether your sentence was "tolled" or the clock was stopped on your probation. I suspect it was not tolled and because of their accident your probation may now be terminated and there may be nothing they can do to correct their mistake. . This is not advice because a lawyer will need to review the Clerk's file in order to determine your probation status.
