DUI parole violation Sno. Co.: In treatment for DUI in Snohomish Co. Have just had a dirty pee test for alcohol. PO has scheduled a hearing. What treatment documentation could be helpful to bring to court? Just getting license back since DUI. Just started working since laid off. Doing well in new treatment program. No dirty tests since. Will any of this make a difference with Judge? Other things I can do to improve situation?

Linda's answer: One of the most helpful things you can do is have your treatment counselor accompany you and your lawyer (I hope you have one for this hearing) in court to speak on your behalf. Urine test can be false-positive for EtOH. Your lawyer should be able to argue this if you believe you have been falsely accused of consuming alcohol.

DUI Expungement Indiana or Washington State: I got a DUI in Indiana while a college student with a Washington State Drivers license. They took my license, I went to court, did the counsellor interview, community service and probation. When I was done, they gave me my license back, and my attorney had me go right away and get an Indiana drivers license. Is the offense under Wa or IN? can I get it expunged? Can I get a WA drivers license now that I have moved back? The counsellor told the court I just did a stupid thing and it would not happen again, it was my first and only offense.

Linda's answer: The offense is where it occurred, so that would be Indiana. However, WA will honor a license suspension of another state if is reported to the National Database. If it has been reported, and you have served any Indiana suspension and have reinstated your driving privilege there, there should be no bar to your getting a WA license again. I suggest that you contact Indiana's DMV and find out whether you hold a valid IN license at this time. If so, you can go to the DOL and surrender your IN license to receive a WA license.

First DWI with BAC 0.16<: Hello, I was arrested for first DWI and my cases is still pending. I have to visit my home country in few weeks, so will i have any problem going out or entering US. I am on h1-b. Thanks a lot for help

Linda's answer: You should re-post this in the "immigration" section. I am not an immigration attorney so this is only a guess--I think that if your case is still pending you should be OK--UNLESS there is a warrant. If there is a warrant, my understanding is that Homeland Security will take you into custody at customs upon your arrival.
