Why should medical malpractice cases be limited to 500,000: n/a

Kay's answer: So called tort "reform" was unnecessary. The alleged "lawsuit crisis" was fabricated by the rich and powerful who wanted to protect doctors, the healthcare industry and huge insurance companies. Tort "reform" has not improved the quality of healthcare in the U.S. In fact, medical errors are on the rise. The only thing tort "reform" has done is harm consumers. I see people every single day in my law practice that I have to turn away because tort "reform" has severely restricted my ability to genuinely help people. In my 28 years of practice, I have very rarely encountered a client who sought to profit from the tragedy that occurred to them or a family member. If you want to learn more, I strongly encourage you to watch the HBO documentary "Hot Coffee". It is also available on DVD.

What can I do about my license and how should I go about handling this situation?: I was in a car accident and had no insurance and it was my fault. The lady I hit was driving a security car ( she's a security guard ) so It was the companys car not hers. I never got out of my car, she did 3 times and walked around before the cop arrived. The damage was 3 tiny scratches to my bumper and the same or none to hers. The cop tried to tell her it wasn't worth making a big deal out of because it wasn't worth 500$. She insisted she wanted to do something because she started saying her back was hurting and crying, she called her boss he came to look at the car and everything and the drove away after some info was exchanged. It's been over a year, I have gotten letters that say I owe her 25,000 and the insurance company she works for took my license saying I owe them 50,000.

Kay's answer: I am sorry for the predicament you are in. I understand that car insurance can be expensive and when finances are tight it could be something a person chooses not to carry. However, it is so very important to carry automobile coverage. It is important for a situation such as yours and it is also important if you were to be hit and injured by someone who did not carry insurance or did not carry enough insurance. Therefore, I always encourage my friends, family and clients to purchase adequate automobile insurance, particularly uninsured and underinsured motorist coverage. Now that you are faced with this situation, you need to hire an experienced personal injury lawyer or insurance defense lawyer who is willing to take your case. You will probably have to put up a retainer fee and pay by the hour. I have additional resources on my website that may assist you. Good luck to you.

Do I need to get a lawyer if I accidentally killed a man?: I was driving at night and he ran out in front of my car.. I hit him and then stopped to see if he was ok. After a few minutes he died. I drove off and the next morning I saw on the news that they are looking for me

Kay's answer: I would also encourage you to report this to your automobile insurance carrier. They will begin an investigation. They will interview witnesses, photograph the scene, etc. If a claim is made against you by the family of the deceased person, it wil be important to preserve any evidence that may exist.
