Gregory’s answer: Maryland Rule 1-203(a) provides that you begin counting the period from the day after the date on the certificate of service. All intermediate Saturdays, Sundays and court holidays should be included. If you were served via mail, Maryland Rule 1-203(c) allows three additional days to be included in the calculation.

Gregory’s answer: If you are convicted it absolutely can be the basis for a violation of your probation. The standard conditions of probation require that you not commit another crime or serious traffic offense, which includes driving under a suspended license. There are, however, legal defenses to driving on a suspended license, namely that you did not do so knowingly and willingly. For this reason, it is critical that you retain an attorney to assist you immediately.

Gregory’s answer: In Maryland, the criminal consequences of a drunk driving charge and the administrative consequences (losing your license) are completely separate. Getting a PBJ will not affect any suspension you may have received. If you did not request a timely administrative hearing your license was automatically suspended on the 46th day after your arrest. There are insufficient facts to determine how long your suspension was, however, once your period of suspension is over you can to the MVA and have your license reissued.
