Move Away Question: How, if at all, can a non-custodial parent initiate a move-away proceeding and attempt to have primary custody transferred to the non-custodial parent so that the child can accompany that parent in his/her move. Assume here that parents share joint legal and joint physical custody and that the child is 3 years old. Do any such cases of this occurring exist? How can a non-custodial parent increase his/her chances of being successful in such an action? Also assume that the person asking this question is an attorney, so I am looking for the most detailed responses/input possible.

Jennifer’s answer: In order to obtain a move away order you would have to, first change custody to you and second that the move would be in the child's best interest.

Jennifer’s answer: All you need is a judgment which determines the legal father of the child and it will entitle you to get a new and correct birth certificate.

Jennifer’s answer: You have to file a petition to terminate the father's parental rights. However, you have to have a new spouse who wants to adopt the child and be married for at least one year.
