I have a felony warrant for not showing for 30 day incarceration on access device fraud if I go to rehab will they come get me?: I didn't show up for a 30 day flat incarceration period cause I was waiting on my ride but got drugged and was found d ad overdosed outside hotel room where people left me so the cops and emts made me go with them to hospital once the revived me and that was morning I was supposed to show up for my incarceration to begin and I was so physically and mentally worn and alot of issues and it had me devastated and I had mental breakdown I slept for like a while month non stop almost and I want to go to rehab now to get clean before I go do the sentence. Will they come get me ?
Michael’s answer: There's no guarantee they will, but they will likely seek you out. At the very least, there will be a bench warrant issued. The best course of action is hiring an attorney to contact the DA and saying that you'll report immediately upon the completion of rehab. If you ignore it, you could be dealing with other issues such as contempt of court. Be proactive about addressing the situation and the fact that you are seeking treatment will not be looked at as anything but a good thing.
What can I do to try and reduce time at sentencing? : My Fiance has a history with PA courts, almost 2 yrs ago he took a plea deal of 2-5 years was put in a drug program and was kicked out, instead of turning himself in he ran. In the year and a half he has been in the other state he has kicked his addiction been clean for almost 2 yr (which was the cause of a lot of his crime sprees) He has stayed out of trouble, became a regular attender and a member of a church, has been mentoring youth to not take the path he did. Recently we went and turned him in so he could get this cleared up and have a real life. I am wanting to write the judge explaining to him all the positive changes he has made,that he has a large positive support system. In hopes of reducing his time. Also we just recently found out his daughters mother is terminally ill and the daughter went to the state, he wants custody which is another reason we are hoping for a shorter sentence. Any advice on what if anything we can do before his sentencing?
Michael’s answer: The first thing you should do is hire an attorney. If I understand your scenario though, it would appear that he violated state parole which would involve serving backtime. This would not be up to a sentencing judge but instead the state parole board. You should sit with someone to discuss this in depth.

This is not part of the conviction or sentence, however a licensing board can punish you by censuring you, suspending you or revoking your license. You should contact an attorney immediately to see what can be done at this point.
