Robert’s answer: A report would need to be filed with the PD. Then, you both need attorneys, especially if you have visa/immigration issues.
If someone is on probation for an Injury to a Child/or Elderly felony and fail their drug test for PO, will they go to prison?: They were never arrested before the felony charge. They were sentenced to 7 years of probation and this is the 2nd time in 4 years that they have failed their drug test for marijuana. The charge says "motion to proceed with adj of guilt". Does this mean they are filing to revoke probation and send them to prison for the rest of the 7yr sentence? (the next 3 years) Or will they be sent to rehab again and given a chance since they are not a danger to society?
Robert’s answer: The punishment (including prison) depends on the actual sentence from that case. Call a local attorney, give the case/cause number, and see what the options are.
Arrested for pocs over a gram under 4. Heroin.:
It's my first felony charge, I have a pending dwi from 4 years ago in a different county in tx. other than that I have nothing on my record. No convictions, no other felony charges. Since my arrest I, on my own(I was not ordered to), attend na regularly, have a full time job, and hired a counselor that I see weekly going on three
Months now. I haven't failed any pretrial drug tests and have been totally compliant with my pretrial officer. I am obviously changing my ways and am moving in the right direction in life. What are the chances of avoiding jail time and getting probation? I have also not been indicted yet. I was arrested in September.
Robert’s answer:
In Travis County, if we can document the progress you describe, then you have a shot at probation. Over a Gram makes it more of an uphill battle, but you should have options.
Call around and speak with a few Attorneys in the area.
