Am I not entitled to wage-loss benefits after being let go from a job post-injury?: I had surgery for a work injury and was placed on a light duty/10 lb restriction by my doctor. My employer gave me light duty but then let me go without explanation. The workers’ comp adjuster says I already had my wage-loss benefits during surgery recovery and I’m not entitled to more, even though I don't have suitable light duty work. Since I’m still under restrictions and not cleared for full duty, am I eligible for ongoing wage-loss benefits in PA?

This doesn't sound right to me and I suppose I'm wondering if attorneys take this sort of thing in contingency if it is, in fact, not right.

Timothy’s answer: The adjuster is not right, and workers' compensation attorneys do work on a contingency fee, so I agree with the other posters that you should obtain legal counsel as soon as possible.

Can my employer give me safety point write up for reporting an injury 2 hrs after the incident if I wasn't aware I had the injur: I work in a freezer warehouse that is -20 -10 we recently had alot of snow build up on our ceilings. This snow typically falls on us in heavy volumes, I was riding in a pallet jack this snow spontaneously fell on me my one foot slipped off the pallet jack causing my right foot to twist and gave me minor pain in the moment but being I was so cold I didn't feel anything immediately after until I had to report to work in the office about 2hrs later. Once I warmed up I felt slight pain and reported the injury now my company has given me a safety point saying I reported the injury to late even though I explained I didn't feel any pain or after effects until I warmed up, can they legally do this ?

Timothy’s answer: I would agree with the other posters. At a minimum, you should contact a local workers' compensation attorney to discuss your options.

Timothy’s answer: Unless there was a special agreement for faster payment, they have up to 30 days from the decision date to make payment.
