Im an employer..what can Iegally ask an applicant regarding his misdemeanor DUI: Applicant discloses the date of a recent DUI but answers no on the application “have you ever pled guilty of a misdemeanor”. When the background check comes back...it shows that he has had 2 misdemeanors...what can I legally ask him?

Should i request a DMV hearing: Even if I don't know the results of my Breathalyzer test? How much does it cost to obtain the police departments copy of the report the day I was pulled over for a DUI?
I know I will probably get convicted of a first (AND LAST) offense DUI - Stupid me, and thank God nobody was hurt, I WILL NEVER EVER drink and drive again, let alone drink.
Please let me know. I would like to get this over with and move on with my life.

Adam’s answer: ALWAYS request a DMV hearing.

Why request one? There are many good reasons to request a hearing, some of which you point out in your above question: you don't know the results of your breath test, you don't know if the proper procedure was followed and you don't know your rights to contest this DMV administrative action. Yes you should request a DMV hearing.

(Also the added benefit to requesting a DMV hearing is that a stay is placed on the suspension action until the hearing is held and a decision is reached. This "stay" is often longer than the 30 day temporary suspended license that you were given at your DUI arrest)
