Can I leave the country if I'm on probation for felony and I'm a permanent resident with green card. My father is seriously sick: I was charge with a felony case and I ended up with a probation, which states I can travel but with consent of my probation officer. I have a green card, my father is seriously I'll ( almost dying ) in my home country, can I go to see my father in my home country and come back to the US.

Ricky’s answer: I would not travel without meeting with an immigration attorney. I have represented more then one person who was detained coming back into the United States even though they got permission from their PO. Not all felonies are equal, and quite a few can leas to deportation.

What are my next steps (I-130/I-485): Hello, I am 27 years old, unmarried from El Salvador. My mother who was a permanent resident at the time, filed an i-130 for me back in 2010 ( I was under 21 so F2A but guess it's now F2B) and I got an approval letter saying there wasn't any visas at the time. My priority date was April 10, 2010, which is now current according to the December 2016 Visa Bulletin as it says F2B is at May 2010. I live in the United States, arrived on a tourist visa, and have TPS which I was granted in 2000 before my I-94 expired so no prior unlawful status. My mother became a US citizen this month. I know that I have to write a letter to change category from F2B to F1 with a copy of my mother's citizenship certificate. However, given the fact that with my F2B category I have a current priority date, (1) should I do this regardless? (2)What do I do now in terms of moving forward with my case? I have been told I have to call USCIS and notify them so that I can get the approval letter which I then file with my I-485, and I wanted an expert opinion.

Ricky’s answer: Hello, you probably want to consult with an attorney to make sure nothing gets missed, but it sounds like you can proceed to become a lawful permanent resident.

Can one change the visa from b2 to f2?: I am f1 visa holder and i have 2 more years. My daugter came to visit me as a surprise with her grandma in b2 visa. I want her stay here with me until i finish my school. So can we change her status as a dependent on me?
