In 1998 I have a misdemeanor failure to show up for jail. Can that be removed from my record?: I was suppose to show up in Appleton in July but Milwaukee said they would have room in December. I turned myself in at Appleton January 1st 1999.

Karyn's answer: In 1999, under the old expunction law, a misdemeanor could be expunged if you were under 21 at the time of the offense. Some judges interpret the old expunction law as requiring that the court approve of expunction at the time of sentencing. (Although, I respectfully disagree with this interpretation.) Under the new law, a misdemeanor may be expunged if you were under 25 at the time of the offense. In a rare case, an attorney may be able to convince a prosecutor to reopen and dismiss the charge, or reopen and amend/expunge the charge. If your case does not fit under the old or new law, you could bring a motion arguing the court has the inherent authorty to expunge in any circumstanes. If you case fits under the new law and not the old law, you could bring a motion arguing the new expunction law should apply retroactively. An attorney would be necessary to make either of these arguments. Variations of this question are asked repeatedly on Avvo. Do some research on this site. Good luck!

Are all retail thefts considered a misdemeanor?: I was issued a citation for retail theft under $500 in March. It was not mandatory for me to appear in court, and I paid the fine before that date. I was never arrested or convicted of anything. Is this considered a misdemeanor? Thanks.

Second underage in a year and half.: I received my second underage in Oconto County while a passenger in a vehicle. The driver was also underage and drunk-however was not ticket or breathalyzed. The first underage was in Dane county last November. I actually don't know if I got a ticket for the second one. The cop was real nice and said he'd mail me my ticket after writing my info down on a notepad. Will I actually be getting a ticket? can they mail it? and how so if they let the underage driver go?

Karyn's answer: Yes, the ticket may be mailed. As the first answer indicated, the officer does not have to cite the driver in order to cite you. Personally, I would not call to check on the ticket. The officer may forget or decide not to charge you. But, you don't want to remind him that you are sitting there and waiting for a ticket...Let sleeping dogs lie. Good luck!
