Do u think my employer threatened me? And what can I do about it?: My employer told me that in order for me to get my last paycheck..I had to turn in my shirts first so there wouldn't be any problems. What kind of problems?? And they never told me why they where firing me.

Gordon's answer: I'm not sure that I would characterize the employer's statement as a threat, but it does appear to violate Wisconsin law. Wisconsin law requires an employer to pay you your last paycheck on the next regular payday. No exceptions. Pay for any time, generally, must be made within 30 days of the date worked. These two provisions can sometimes work together. If you cannot get your check, contact the Wage and Hour Bureau of Wisconsin's Department of Workforce Development in Madison or Milwaukee to file a complaint. They will help you get your check pretty quickly. If not, a private attorney may also be able to help.

Gordon's answer: Wisconsin law does prohibit employment discrimination based on a conviction record with 2 essential exceptions. One is a new law that says educational institutions do not have to hire, and can even fire, someone with a felony conviction. The other is a defense to the claim of discrimination, where the employer can claim that the job and conviction are substantially related in a manner that makes reoffending a substantial risk. The last potential issue I find is an employer claims that the employee or applicant lied on the application for employment by either failing to disclose a conviction or by misrepresenting the nature of the conviction. This defense can work in some, but not all circumstances. You have to consider the impact of these factors when deciding whether a claim exists. If you want to pursue a claim, you should file a complaint with the Equal Rights Division, Department of Workforce Development for Wisconsin. Do so within 300 days or you will lose your right to pursue the claim. An attorney may be able to help you with this. Can my employer legally force my husband to take health care coverage provided by his employer and remove him from mine?: I've had my employers group health plan since I was hired in '99. When I married in '03 I changed it from Individual to Family and it remains so today. My employer now says any spouse who's offered coverage thru their work must take it, and is asking for Provider info/eligibility dates, etc. My husband's employer is refusing to release benefits information "to outside agencies", and according to their attorney is not required to do so. My employer is threatening to contact our Provider and move my husband to secondary coverage if we do not provide this information.

Gordon's answer: Frankly, I'm not sure what the answer is to your question. It sounds doubtful that one employer can force you to drop an eligible insured from your policy and force you to take out another through the spouse's employment. It costs you more, I would believe. You may want to consult with an attorney for a review of the situation and the policies you have in place. The policies may provide the answer.
