Hi, i was in an accident this past summer. A car driving way past the speed limit, not wearing a seat belt, counting money hit me: He totaled my car,and i had no choice but to get rid of it. He injured my left side since that morning. I have pain on a daily bases. I want to sue him not only for the damage he did to my car but the ambulence and medical bills as well as the physical theropy and pain and suffering. He made me afraid to drive, iam so parnoid now. Please help me guide me how to go about suing him
Paul's answer: They don't teach personal responsibility when obtaining one's driving privileges in Connecticut but they should. My office handles such matters involving auto and Trucking accidents among other types of serious injury claims. Also, I do have a suggestion for a more local firm if you prefer in the Danbury area as my office is in Hartford so give me a call or send me an email noting your preference. You have been very patient and it would be a good idea at this point to engage counsel in my view. Regards. Can I still collect workers comp?: if I'm granted workers comp? Can I still look for a new job? And if I were to get hired at a new place, would I still be able to collect my workers comp or would those benefits stop once I started a new job? Is there such thing as partial workers comp?
Paul's answer: The decision to look for a new job while still eligible for workers compensation benefits from an existing position is a delicate one and depends upon the nature of the injury, anticipated further medical care and associated time loss balanced against the need to secure one's longer term future. Obviously, exploring career options is different that accepting a position which may very well disqualify one from the receipt of current wage indemnity benefits. There are certain types of workers compensation benefits in Connecticut which may be collected in addition to wages from an employer but those are generally only available after one has concluded treatment and reached maximum medical improvement. It would be wise to consult legal counsel where any serious injury may be involved before making uninformed decisions. Can i sue my employer while on workman comp?: I received the steroids did not help me I recieved the injections in my back did not help me I received the dye in my back did not help me Now they want to do surgey in January
Paul's answer: From the standpoint of a Connecticut attorney who practices workers compensation as well as tort law and who has done exactly what your question requests to know, the answer is that it is achievable under limited circumstances. The fact that you need surgery after having tried other more conservative means of treatment suggests that attorney guidance is essential. You have not provided enough information in order to determine what legal options you may have in addition to the aggressive pursuit of your rights as a worker injured in the course of employment. I would be happy to consider the entire situation and provide more specific guidance, but not in an on line format. Feel free to contact me for further discussion.
