Case settled, atty said medicare had lien, medicare paid nothing. Can my attorney look to add other insurers to settlement?: Wrongful death lawsuit. Mediation agreement only list Medicare as payer. But they have closed their file and paid nothing. I won't allow my attorney to look for others who may have paid because he did not include anyone else in the agreement to be paid. Money in escrow account since beginning of the year. This is Georgia.

Jonathan's answer: Because you have an attorney, you should consult with that attorney for legal advice regarding this matter. However, generally speaking, since the tort reform of 2005, hospitals and doctors are given statutory liens against a settlement for health care they provided if they follow the rules to effect those liens. Whether your lawyer looks for them or not, those liens may exist and can be enforced against your settlement. You would be wise to listen to the counsel of your lawyer so that you can get these issues resolved and not have to look over your shoulder down the road to see if someone is coming to attempt to collect on a lien.

My brother took out a loan for 50K with both of our names on the paper I am not sure if he he forged my name.: I never authorized this he may have duped me into signing this paper by telling me it was for something else

Jonathan's answer: If he forged your name then an attorney can help you remove your name from the contract by hiring a handwriting expert and suing in superior court and an injunction removing your name. It could get pretty expensive. However, if you signed and didn't read the contract, then you are bound by the contract because it is presumed that you have read what you signed.
