Can you Sue your employer or state if mask mandates cause face irritation?: What happens if you request a reasonable accommodation to work from home because wearing a masks irritating nose that caused a huge cyst that's needs to be surgically removed?

What happens if you provided your employer the documents and request to provide accommodations and they are not responding to request and forcing you to work when your are experiencing internal damage?????

William’s answer: Attorney Peckman is correct your remedy is a New York Workers Compensation case. Generally, you must give notice within 30 days of learning that the condition is related to your work and file a claim within two years. Making a claim may get you the attention that you seek otherwise you do need to seek an opinion of an attorney that handles such matters as it is outside of the workers' compensation law.

Do i need NYS worker's comp insurance for a corporation that never started operating?: Hello. I am the sole officer of a corporation that has 5 shareholders (I own 90% of the shares).

The corporation was created to build a restaurant, but the restaurant was never launched or started operating (expected operating is at the end of the year). Since we never started operating, we never had any employees. Even myself (the sole officer) was never an employee and never received a salary, since the operation of the business never started, and I really didn't have a job to do.

I got a letter from NYS saying that I need workers comp insurance and I don't have it. Do I need insurance even though I never had employees?

It's a c-corporation with one officer and 5 share holders.

Employer called and canceled my occupational health and wellness appointment after being injured at work. : I was injured at work. Brought in my doctor's note and my employer told me I was being denied workers comp before even filling out the paperwork. She then told me she was canceling my occupational health and wellness appointment that I was just given by the doctor. There's so much more. Is any of this legal?

William’s answer: Your employer's actions clearly mean that you need representation now. Your employer has no right to cancel a medical appointment however they can indicate that they will not pay. Many medical providers will treat you while the battle is being fought in court. An attorney will need much more information to provide you with a strategy. Delays will hurt your case. My advice is to cal and attorney right away.
