Is it an illegal contract when I make a loan to a business that sells medical marijuana: Would it be considered an illegal contract in the State of Florida, if a Florida resident loaned money to a resident from another State, as capital for his/her business venture to sell medical marijuana. If the person defaults on the loan, would a Florida court recognize the contract.

Gust's answer: I would make the loan as a personal loan to the individual. This arrangement is enforceable regardless of what the person does with the money and is not subject to corporate protections! The sale of medical marijuana is still a questionable activity since it is a scheduled drug. I would use the KISS concept (Keep It Simple Stupid). Good luck.

Do I have to register as an escrow agent for this business?: Looking into a new business idea. My business would be responsible for the transportation of the goods. Some clients would handle the funds on their own, however to ensure a safer transaction some buyers may pay us directly (via wire, check, or cashiers check to hold) and once the goods are in our possession we could then release the funds to the seller. Do I have to register as any kind of escrow agency? I would not be advertising as an escrow company. Primarily the business would be for the transportation of the goods.

Gust's answer: This is really the type of question a local attorney can answer. Different businesses have different regulations. If you are shipping firearms it is very different than medical supplies, etc. I would suggest a local business attorney to setup your structure and help with legal compliance.

What can I do to keep my X domestic partner away from me? We are going thru a break up but are forced to cohabitate together.: My X is extremely emotionally and psycologically abusive and has been physical a couple of times. I am moving out but my new home wont be available until mid Janurary. I cannot leave where I have been living as I work in a virtual office from home operating spacific equipment from my home office for work. She does things that are crazy for instance..putting ice cubes in my bed. Purposfully saying hurtful nansty things and threatening me verbally..Just last night she presented me with a notice she said was taped to the door for me from my leasing office stating that they want me to get out by Friday and to surrender to a sheriff. It looked very official and even signed by my leasing agent...I got upset and phoned them this morning..they never left this notice and knew nothign of it.

Gust's answer: I would suggest leaving ASAP. When you live with someone they have access to ALL your stuff. The law will help but the reality is you need to get out of there and end the relationship.
