Do I have a case?: I was in a head on mva in Feb 2025. I broke my femur and greater trochanter along with internal injuries. The er ortho put a metal plate with 6 screws in my femur on Feb 13 2025. On a follow up appt Sept 2025 I found out thru xtays that a screw broke The ortho said "it's OK. It's a just in case screw there's 5 more. We'll in November I crossed one leg over the other while standing and was in extreme pain. I went to er and learned all screw were broken and my plate was lifted off the femur. The ortho refused to see me and I was sent to ucsf for a extensive 8 hour surgery to repair my femur. I was put on antibiotics for a bone infection for 3 months. I also had to start my healing all over again. As of today May 29 2026 I'm still recovering and I still have pain daily. My quality of life has gone down alot because of this injury. I can't do much because of the pain limits me in daily activities. Can I sue the ortho who disregarding the first screw breaking? I had expressed in every follow up with him that my leg didn't feel right and felt like it would buckle on me. I have access to all medical reports from all hospitals.

Armen’s answer: You may have a case against the ortho. Having said that, the statute of limitations or fast approaching, namely September of 2026. Your records should be reviewed, in addition to a detailed interview to weigh the merits of the case. Note, personal injury, auto accident case, if not against a governmental entity, is two years.

Hi, I am running out of time to take action against a hospital.: My fiance died because, we are told she pulled out her breathing tube while on a ventilator. She was in a coma and her medical records show no checking on her from 7am to 3pm while in the ICU. The records show a lot of failure that day leading up to her death at 7pm.
