He did this without my knowledge or consent. My attorney had been waiting to hear from his because I was filing married filing separately and claiming both kids since they lived with me for 8 months out of the year. What do we need to do now he has filed and received the return.

What should I do?: My Dominican wife left me after about 8 months of living with me haven married me in the Dominican Republic. We lived in Queens NY, i have tried to work things out but she refuses to come back but she and I have also placed a petition to bring her 15 year old daughter to come to the states as well. I do not want to lie to the American government and my wife is asking for me to bring her daughter regardless of our marital status. I didnt want a divorce but she's forcing my hand.
David’s answer:
If your wife has left the marital home and refuses to reconcile, you likely have grounds to file for divorce in New York based on abandonment or irretrievable breakdown of the marriage. Even if you didn’t want a divorce, you can’t be forced to stay in a marriage where your spouse has effectively ended the relationship.
Since you’ve lived together in Queens, you likely meet the residency requirements to file in New York.
You don’t have to go through this alone — we can help.
David Centeno Law focuses exclusively on New York divorce and offers free consultations. Let’s talk through your options confidentially.
