Can I cancel my pending AOS and apply for F1 : Hi I am currently a pending AOS but due to personal reasons I am no longer interested in immigrating to US, however I have started a degree which I would like to complete. Now my question is can I cancel my AOS and apply for F1 while I am still in USA ? I also hold a graduate assistantship which I am legally able to do due to my AOS based EAD. Please tell me how the process will go. Will I need to first cancel AOS , then apply for F1 and in the meanwhile discontinue work till my application is approved or can I apply for F1 and while AOS application is pending as is so I can legally work and stay in USA while my application is pending .

You can apply for an F1 student via, however, you must be in legal status on the date of application. This may be difficult if you entered as a tourist (b-2) Additionally you may encounter the issue of immigrant intent. To obtain a student visa you must have a non-immigrant intent, otherwise the USCIS will presume that you have an immigrant intent, which will disqualify you for a student visa,
