  • How do I get a public defendant?

    My finances make it not possible to afford an attorney. I do not know if I'm being prosecuted yet or a misdemeanor. Is there a way I could speak to someone with experience that would not be expensive?

    Technically, the Courts will not appoint a public defender until after the case is charged and you have been arraigned. Just call a local attorney and see if they will do a free initial consultation. Most will. Good luck.

  • Can I get my gun rights back if its been over 10yrs but still owe a fine?

    It's been 10 yrs since me and 3 others got a B&E charge but still owe around $40,000 in fines which started at around $20,000 but keeps growing with interest. At this rate it will never be paid off and wonder if I can ever get my rights back

    The other answer is correct, but also your "clock" of crime free behavior has not started to run because you have not finished all the obligations on your sentence. I assume that all fines need to be paid as the last obligation on your sentence before you are technically discharged from your sentence. Clock doesn't run until your last obligation is met. Sorry.

    Prosecutors can get wrapped up in these long and emotional cases, and they always believe that they wear a white hat. In some instances, this can lead to them unknowingly crossing the boundaries of what is appropriate and ethical. This is a situation where that Prosecutor definitely crossed the line. I'm sure upon reflection, they would realize their error. Anyway, I would go make a formal complaint with the elected Prosecutor.

    I am assuming that this is in Kitsap District Court or Port Orchard Municipal. Either way, both Courts are fairly good about quashing the warrants at the warrant quash hearing. That being said, a lot will hinge on what the underlying charge is, and if you have other history of failing to appear. If your charge is a DUI or a domestic violence charge, there is a higher possibility that you will be taken into custody. Assume that the Court will charge you a $100 warrant quash fee. It is helpful to have a defense attorney there with you, and throughout the rest of the case. My firm is in Kitsap County and we handle this situation all the time.     Hard to say what will happen without knowing what Court you are referencing, but I would imagine that you can have your attorney explain your situation to the Prosecutor that is handling the Diversion Court, and just make a request for a continuance. Unless you are asking for multiple continuances, they will almost always grant a continuance for you to fulfill the terms of your diversion. If you don't have an attorney representing you, you may want to talk to a local attorney about your diversion and have them work with the Prosecutor for you.     I'm sure there are a lot of other facts not stated in your question, but the thought that comes to my mind is jurisdiction. The Prosecution need to be able to prove that this occurred in Washington State. What's to say this didn't happen in Idaho or Oregon? Also, they would need to prove when (or at least a range of dates when) this happened. What's to say the video wasn't shot many years ago? Just my thoughts. You and/or you husband need to talk to a reputable defense attorney in your area. Best of luck.

    All of these steps require an attorney. Get an attorney - they need to obtain from the Superior Court the application for the Search Warrant. Then, assuming the attorney knows what issues to look for in a search warrant application, they need to go through and look for errors in written or verbal application. Good luck.
