My legal expertise include: mostly DUI and other criminal defense; and, selected family law, stressing mediation to avoid trial whenever possible. In the DUI/Criminal Defense arena, I feature a special focus on effectively presenting criminal defendants’ dual diagnosis conditions. my clients avoid a lot of jail time from this creative approach. I am experienced in creating unique and time-proven approaches to criminal defense matters. I have been practicing law in the Seattle-Everett-Tacoma area since 1986, with over 28 years of experience in criminal and DUI defense and family law. I am a member in good standing with the Washington State Bar Association and belong to several professional associations. I have also been a member of the Washington State Trial Lawyers Association, Washington Association of Criminal Defense Lawyers the American Trial Lawyers Association, the American Bar Association and the National Association of Criminal Defense Lawyers. I hold a Bachelor of Arts Degree from Lake Forest College (1972), where I majored in Chemistry and International Relations and was consistently on the Dean’s List and was nominated Pi Sigma Alpha, the National Political Science Honor Society (the only honor society for college and university students of government in the United States). I received my law degree (J.D., Juris Doctor) from The John Marshall Law School in Chicago in 1982, graduating “with distinction,” in the top 11% of my graduating class, and was elected by the faculty to the Order of John Marshall, an honorary scholastic society. I have passed both the Illinois and Washington State Bar exams (the first time I took them; Many attorneys must take the bar exam more than one time to pass). I have been helping people save their driver’s licenses and their freedom since 1986 and have been told many times that I saved people from very tough legal dilemmas and did “a stunning job” representing and defending them. I continuously research the latest cases, legal treatises, scientific literature, and articles on the subjects of drunk driving defense, criminal defense and family law, allowing me to be on the cutting edge at all times. I take a holistic approach to every client, as each person and their case and history is different and unique, and as every client has different legal goals. I know how to read a police report to find issues and angles to help your case, and how to best present you and your case in court and to the prosecutor. I am married, have 2 successful step-sons, one a computer engineer and one a minor league baseball pitcher, and my wife and I enjoy hiking, reading, cooking camping and music. I play the guitar and the drums, too. But getting your case dismissed, always my initial goal with every case, is always music to my ears! I'd like to meet with you so we can go over your case.

Are you an attorney? Endorse this lawyer
Some clients end up wondering if their criminal defense lawyer is secretly working for the prosecution. It's a common question often asked about defense lawyers-- "Whose side are you on?" I've been asked the same question many times over my 40 years of practice. But, with attorney Phil Weinberg you should have no worries. I regularly appear before the same judges in the same courts as Phil, and I am still surprised at his tenacity and zealousness. He is no pushover, and it's easy to see which side he represents. He strongly advocates for his client- he's not beholden to the prosecution.

This lawyer was disciplined by a state licensing authority.
This means the attorney lost his or her license to practice law for a period of time. The attorney typically returns to practicing law when the suspension expires.
Phillip’s comment: “In 2004, representing myself, I agreed voluntarily to a 2-year suspension with the Washington State Bar Association. Out of the 23 years I have practiced law, I was suspended for two of those years. As a result of this 'experience' I am now a better person and attorney.”
