I agree with the other attorney. This is probably not a case you should try to pursue on your own. Contact a local workers compensation attorney. If you can not work because of your medications, and, if the employer can not accommodate your restrictions (e.g. must take pain medication) then you may need to take time off work. That time should be covered by the workers compensation claim. Good luck.

This could be a rather complicated process. I agree with the other attorneys, it may be too complicated for a lay person (it may even be too complicated for an attorney who does not practice in this area of the law). My only two additional suggestions are: (1) Don't forget the "DOE" defendants, just in case you missed someone; and, (2) read up on the laws in your state about joint & several liability before you let anybody out... oh yeah and if you do decide to let someone out, make sure you don't need the court's permission--you don't want the other defendants complaining and jeopardizing the rest of your case. Please remember, this isn't legal advice. It does, however, illustrate how complicated a case like yours can be,

  • Can I request a certain judge?

To the point Husband & friend arrested when pulled over after officer recognized friend in car. Reason was unclear and not valid at time of arrest. Friend went to court w/ a Pub.Def. All chrgs dismissed, his paperwork says, "no probable cause." ...

Unfortunately, In my experience, litigants have zero control over the assigned judge in either civil nor criminal cases. I have been in court at times when we don't know who the judge is yet, and when he or she steps out, there is a quiet but collective groan. I wish I had better news for you, and for me too. Some judges are just better than others--and, some judges make attorneys wonder how they stay on the bench. Good luck though

    Glenn’s Answer

I just settled a case like this with a heavy safe falling on someone who came to help. It becomes a VERY fact sensitive case. Actually, most of the facts supporting (and not supporting) the case did not really come out until we were deep into the deposition process. My point is that a case like this is something you should entrust with a personal injury attorney, to help navigate through. Good luck!

  • My dog bit a stranger. Left Bruise. UC bill $235. Not worth going through home owners insurance. Can I get in trouble for not

I agree with the other posters: I can't tell you how many times a client has come to me because the potential defendant refused to pay a modest medical bill.

    Glenn’s Answer

Have you tried a restraining order? Because he is your ex-husband, it will probably have to be through the family court. It sounds like you may be able to obtain one from a judge. It would be like a no-contact order. good luck!

    Glenn’s Answer

I'm sorry to read about your loss. This is a very difficult case. Im not sure I have much more to add. I agree with the other attorney that there may be a failure to diagnose issue. But, some states insulate doctors they use for certain medical examinations. So it may be important why the Judge sent your wife for an evaluation. So, here's where I would like to add something to the discussion: I also think there may be an issue about your wife becoming addicted to the pain medication. The prescribing doctor may have had some duty to monitor her usage of these powerful drugs. I strongly urge you to seek an attorney in your area. Good luck.

  • I was in a car accident and initially sued beyond policy limits. Now the plaintiff wants the limits.

Basically the plaintiffs want my policy limit now but if my insurance company doesn't meet it, they will ask for more at trial, exposing my personal assets. My insurance company does not believe the case is worth that much and is willing to go to ...

    Glenn’s Answer

I highly recommend that you get a second opinion regarding your policy limits. Consult another attorney. It will probably not cost too much. Dont forget that the insurance company's interests are not necessarily the same as yours. And, dont forget that the attorney is being paid by the insurance company. Good luck

  • If my lawyer fails to object to interrogatories that I believe should be objected to (relevancy) can I amend later?

It is now past the initial 30 day response deadline but more than 4 months before the deadline for discovery. The responses have already been submitted.

    Glenn’s Answer

Even if the attorney had objected to the relevancy, you would have had to provide your response. If it is truly irrlevant, it might not be brought up during the trial--or--you could object to it at that time.

  • Should I get a personal injury attorney or try to negotiate with Geico myself?

My husband and son were hit by a 17 year old girl making a left turn. She was cited by the police and is at fault. My husband suffered sever injuries, resulting in removal of his spleen, a collapsed lung, internal bleeding, blood transfusion and...

    Glenn’s Answer

I agree with the other posters. You need to consult an experienced personal injury attorney. GEICO can be very difficult to deal with. They generally have "staff counsel" so they are not worried about litigation costs. My personal experience has been that they often take positions which can be challenging even for attorneys. Because the injuries are severe, please also take stock of your personal UIM (underinsured motorists) coverage. Best of luck to you, and, best wishes for the recovery of your loved ones.
