    Description:
    D in service and going to afganistan and could not lose or be on probation because of the sensitive nature of his employment and rank. Many motions and contested DMV with inexperienced officer who didnot follow the correc proceedure nor give the correct admonishments paid of for this client big time. Nice client. Officer inexperienced and unprepared. The case began as a refusal with forced BA.. D got terminal sentence . no probation and fine only. Refusal not pursued.

    D pulled over by CHP for running stop sign. My highly experienced investigator and x-cop with over 35 years experience proved cop could not have seen what he claimed. The cop was very good but we were better. Client nice young man but did refuse and it was tape recorded. No jail.

    Defedant was allegedly weaving but I had done a 35 defendant Pitchess motion on the arresting officer (a motion to get the cops personel file)that probably accounted for the fact he was "taken off the street" the day after the motion was served on the Chief of police, City Attorney, Court and copy given to the local Media. Case actually involved cops staking out a bar and I knew they were and proved they waited for people to get into their cars then invented cause to pull them over. I cited over 35 instances of bad acts by this cop and his partner from different cases. My investigator interview more than 60 arrestees after I placed an add in the local paper asking people with complaints re Chico police to contact my office.

    Bad cop did 35 client Pitchess motions on he and his partner. They invent probably cause and either get blood or charge a refusal. My investigator and I worked on these cases more than a year. This is the partner cop to the one in People v. T.C. above.

    client had .11 BA but it was one of the two bad cops in Chico mentioned in the other cases above and pitchess motion and other discovery motions and motions to compel and motions to supress were done and we had an investigator and expert toxicologist from Sacramento. We REALLY had evidence the two cops were both dirty in this one. They had pulled over client other times on numerous occassions when he was not even drinking, once when he had a relative of cop in his car!!

    Murder first degree jury resulted in manslaughter
    Description:
    Client an illegal immigrant got into a fight with a man twice his size over a "professional" woman. Client stuck victim with butcher knife in stomach and killed him. We showed it was self defense. Jury found him guilty of lesser offense of manslaughter and he got sentenced to "time served" as he had a bordr patrol hold on him. He was deported to Mexico but was back in town in two weeks!!

    Description:
    I did all motions , probably 25 at least. It was one of first murder by dui cases in state. D drunk rolls hot rod jeep and passenger killed. I did DMV APS andall motions and Preliminary Examination in the trial court. Dennis Latimer did jury trial. Client plead in 3rd day of trial to manslaughter and got 7years and VOPs and Dui and accompanying charges dismissed. With good time D got 3 years. He had numerous dui priors and was on dui probation Deputy DA who was mean and nasty through entire matter was cited for contempt at PX and later that contributed to her suspension by state bar association and loss of job. I literally drove her nuts .There was no real defense but there was another passenger in the car who was ondui probation and not only had prior DUIs but got one after crash pending trial. We used "SODDI" defense..some other dude did it to wit the passenger. He took the 5th. It worked well. Latimer deserves the credit for the win, but I got a nasty DA! We had great investigation and experts. Facts were awful and 3+ years net was a win
