  • I am on information probation for a DUI and would like to change my last name. Is this possible?

My current last name pulls up on google searches unfavorably so I would like to drop it and use my mother's maiden name as my last name. Do you think I will have an issue making this change in court. I know everything still shows up on backgroun...

    John’s Answer

You are legal to use ANY name you want as long as it is not to commit fraud. How you change your name on your drivers license I do not know off hand. But I am sure some other lawyer answering your question will know. If not call the local DMV and just ask them. Many people may say you cannot just change your name. They are mistaken. • I hit a bicycle rider I wasn't arrested or given a ticket Gave blood sample I was taking norco from back surgery. What do I do

I passed field test no alcohol in system. I was prescribed norco and Xanax from back surgery. Accident happened 2 months ago. Detective states still waiting on toxicology report.

    John’s Answer

Get the best lawyer in the jurisdiction of the alleged offense. If you also drank any alcohol ( statement you made on AVVO leaves out issues), a lawyer needs to call DMV within 10 calendar days of the arrest or you WILL lose your license even before court if any. Many questions arise a lawyer needs to ask. Do you fill your own teeth? I thought not GET a lawyer YESTERDAY get a "10" rated lawyer or go to www.california-dui-lawyers.org and find one...Duiking 41 years

  • Probation Dui classes

I just got out of jail and ordered to complete MADD, SCRAM and DUI classes. I did 5 months (half time) for my third DUI. What if I currently dont have all that money for all those programs? Do I put myself back in Calendar? Will the judge lock m...

    John’s Answer

If you had a private lawyer or a public defender have them put it back on calendar. If you do not feel you can do it yourself go to the clerk of the court and have it put on calendar and ask for information on how to get a public defender to help you. The worst thing you could do is nothing. The other answers by the other lawyers here on AVVO are correct, listen to all of them. If a relative can afford to hire a LA lawyer you might try that. Often lawyers consult on what to do for free or a nominal fee. If you have other questions post them ASAP. Good luck. Joe Vandervoort Butte County

More information needed. Where, why, arrested? etc all the other answers are OK, but without more information specific advice cannot be meaningfully given. Call a LOCAL lawyer . Ive been practicing in Butte County 42 years. www.duiking.com or see www.california-dui-lawyers.org for more lawyers in Butte Area assuming the arrest was in Paradise as implied though that information also left out of inquiry

  • I got my first DUI recently in Butte Co. (Gridley, CA). What can I expect to happen?

I was pulled over for driving slow. (I was looking on the street for a fallen helmet in the dark). I wasn't drunk or impaired. The arresting officer nor the jail will tell me my BAC. The paper they gave me in place of my license has expired and I ...

    John’s Answer

I have handled Butte County DUI/DMV over 40 years. If what you say is true you have a defendable case. If you do not have representation you are looking at further suspensions, jail, DUI school, probation at least 3 years and fines in excess of $2,000.00 and possible other sanctions depending upon you record and case facts and BA. If you hire an attorney you will never have to go to court. I have not had a first offense client go to jail in over 10 years. Depending upon service of notice and other legal technicalities you MIGHT be able to still get a DMV hearing and save your license. Most lawyers give FREE consultation so what is to lose by contacting one. go to www.California-dui-lawyers.org where all good dui lawyers are listed by county. Type in Butte County. You will find 10 lawyers. One specialist rated and one with over 20 years experience

  • What is going to happen?

I am on probation in Ga for an underage DUI charge, but have moved to Ca for school. I have not been able to pay my fees lately due to lack of finances it's been some months. Therefore I violated my probation. I just got a misdemeanor ticket in Ca...

    John’s Answer

First! Get an LA attorney. If still under age and convicted of ANY alcohol offense driving or not you will lose any CA drivers license one year or more. If the court does not take it DMV in Ca will. You might get a hardship license (no room to explain). See AVVO guides. If under 18 and juvenile this does not apply but I assume you are under 21 over 18. Most lawyers even a public appointed lawyer can get the open container dismissed for a plea to trespass. you and your buddy MIGHT consider getting the same lawyer if no conflict of interest. An alcohol offense may even affect school and your attempts to get financial aid. This is a serious matter. If the DA then court find out re DUI in GA things are worse. And worse at DMV eventually. Call a lwyer, if did not previously have one, look on AVVO to "fix" GA mess. take responsibility and mow lawns and wash cares if necessary. No judge nor anyone else wants to hear "I just am short of finances" that means lazy to many. Good luck...hey I SAY IT STRAIGHT.

  • Could a public defender negotiate a better deal for me than my private attorney has done?

Im being charged with VC 23152a and HS 11550 in Riverside county. First offender, no injuries, no alcohol and over 21. Methamphetamine was in blood. With what little money my mom had she hired a private attorney to try and keep me out of jail. My...

Quit listening to outsiders. PRAISE your mother. What happened to the dui? Any DMV hearing? if your lawyer is getting rehab with no jail from what I have read about Riverside you should be praising your lawyer also. Sounds like you need rehab if you are even getting with 5 miles of METH (the choice of losers). PAY back you Mom!!! and take responsibility for being irresponsible. I don't know Public Defenders in Riverside and maybe they are awesome. But, it has been my experience and I have 42 years that PDs usually have sooo many cases they have little time to handle a case like a private lawyer can and sometimes they are young men or women in the profession or old burn outs. On the other have PDs know the politics and local system. But PDs USUALLY have to think about to many clients and their "future dealings with the DA and or judges", to put it on the line for one client. If I am wrong I apologize. Also, as a GENERAL rule "never change horses in midstream". Your mom sounds like the woman who put "two mites" , two pennies (all she had) in the Agape box as Jesus (from a far) stated to his apostles.."she gave more than all the rich in purple robes (meaning the lawyers & politicians of the day). Do rehab and MAYBE expunge your case later IF you succeed. Make Mom and others proud and do yourself a favor!

GET a lawyer. Such a matter will follow you your whole life. What are you going to do with the "discovery" if you are not a lawyer? If you get your x-rays are you competent to do surgery.
