There are a number of factors that go into who pays for damages. The first of which being "liability." That is, who is responsible for the collision. The fact that you were struck in the rear of your vehicle, coupled with the police report citing the adverse driver as "at fault" are certainly good evidence to suggest that liability falls to the person that hit you. The next piece of the puzzle has to do with the level of insurance you and the adverse driver has. versus the extent of your...

Wow....I am very sorry that this is going on. Dog bites tend to be very complicated, especially when renters are involved. What I would particularly like to know is whether the insurance company you are referring to is the home owner's insurance or the renter's insurance. There are certain things you have to prove relative to the home owner that are different than the owner of the dog. Particularly a landowner who rents to a dog owner is liable so long as he knows of the dog's dangerous...

I would recommend you contact an attorney without delay. In California you have two years from the date of injury to bring a claim, unless the claim is against a public entity, in which case you only have six months. Contact an attorney as soon as possible. I wish you well in dealing with these unfortunate circumstances.

There is a question of premises liability, there is almost always a question of whether your daughter "assumed the risk" of the puddle. Almost every school who offers sports at any level have waivers that athletes sign stating that they are assuming the risks associated with the sport and that they will not hold anyone from the school, including coaches, liable for injury. Given the above, I doubt anyone would be able to give you an adequate answer with the basic facts you have given (which...

You should absolutely call a medical malpractice attorney without delay. The Statute of Limitations for medical malpractice claims can be very tricky. I do not know the details of your injury, but generally you have one year from the discovery of the negligent act. So I would recommend that you contact an attorney ASAP. If you would like a recommendation to a good medical malpractice attorney you are welcome to email me or you can use the Avvo find a lawyer tab. I wish you luck with dealing...
