  • Is it possible for me to get out of a contract with a publisher I am uncomfortable with. (Any advice would be helpful)

I'm trying to figure out if I can get out of my book contract with a publisher that I no longer feel comfortable with. Both contracts are already set to be terminated in May and August, but recently some event have occurred that have given me reas...

    Lori’s Answer

Aside from carefully reviewing the terms of the contract, you should clarify what exactly the publisher did to cause you to reconsider doing business with them. If their conduct was illegal in any manner, that is usually sufficient to justify voiding the contract or at least, providing sufficient grounds to consider the contract voidable.

  • I live in Richmond, VA & believe I was wrongfully terminated in March of 2013.

Can I still file suite against the government agency after 2 years?

    Lori’s Answer

You have to contact an attorney in the State you were terminated; laws vary from state to state, particularly when an action may be against a public entity.

  • Wrongful termination?

I am 19 and I was recently terminated from my job, but they didn't tell me, They told my mother, who is a store manager. What can i do? What are my rights?

    Lori’s Answer

It's not clear what your question is and without more facts it is impossible to determine whether or not your termination was wrongful. The issue regarding your employer talking to your mother about your termination is likely to be considered an invasion of privacy but what are your damages?

  • What does an outline of a wrongfull termination case look like?

If I decide to proceed with a wrongfull termination lawsuit after filing for a right to sue letter with the DFEH what is the process from this point forward? How long do cases like these typically last? How long does it take to file a lawsuit?

    Lori’s Answer

Once you file your DFEH claim, your statute begins to run one year from the date that DFEH issues you a Right to Sue. You also have the option of asking for an immediate right to sue and then you can proceed directly to court.

    Hope this helps.

    Lori’s Answer

Yes of course you can given the outcome of your arbitration. However, I agree with Mr. Holzman that suing an individual and trying to obtain recompense for 1 1/2 years out of work may prove to be difficult. It all depends on the financial sovency of the individual who committed the slander.

    Lori’s Answer

Employers should not be asking their employees to commit fraud or violate the law in any way. However, you have little recourse here. You can report them to licensing if they continue to force you to do work you are not licensed to perform. if you are fired in retaliation then you may have a case against them.

    Lori’s Answer

I think it's troublesome that Corporate told you to return to work and to not worry. I suggest you ask for your employment file and review it carefully. Most attorneys would want to review this in determining whether or not you have sufficient grounds to go forward on a claim.

    Lori’s Answer

Good news is that you have not been terminated yet! Get an attorney who can address the facts and advocate on your behalf - they may be able to intervene prior to a termination. if not, I think you may have a case and would strongly suggest pursuing.
