I work for a small firm (information not disclosed due to confidentiality) and just finally got my H-1B approved because of Jay!!! I cannot be more happier about outcome of my case and feel that I have won a battle with US Immigration. USCIS literally dragged me into very deep waters and I navigated and came out just fine, because of Jay. I hope these insights into my case will help readers facing the similar difficult situation. So I graduated from a US University in 2014 with a masters degree in Fiance. I found an entry level job on my OPT at a small company in California that offered me a position to write financial business plans for its investment clients. I thought that H-1B were an easy task and everyone who is getting paid by the US employer and specially if someone has a US degree could be easily approved. I could not be more wrong. This was a hybrid position that required use of principles of finance and a masters degree in finance. But at the same time, this was not a conventional position of financial analyst or accountant or any of the standard finance positions. Since it involved in pure writing and analysis the initial H-1B was filed for the position of Technical Writers (O*net SOC Code 27-3042.00) as there was no other suitable title available. Jay told me even before filing the H-1B that what will be the problem with filing. Because of unconventional nature of position (this being new position in the market) and small size of employer, USCIS will question both the position and business and availability of work. I did not pay any attention at that time, and thought this will just get approved without any issue.
USCIS initially issued an RFE questioning Specialty Occupation and asked to prove how a degree in fiance is required for the position of Business Plan Writer (Technical Writer). Jay prepared a very thorough response and answered the RFE. He involved a fiance professor from NYU Stern School of Business and established that a degree in fiance is the way to go for the position. Jay argued rather agressively that this was a new position and explained reason for unavailability of evidence USCIS was asking. Anyways! The RFE Response was submitted and I thought this is past me and I should receive an approval very soon because case was under premium processing. To my surprise, USCIS issued a "Notice of Intent to Deny" stating that Technical Writer job title is reserved only for engineers for writing technical manuals. And not applicable to people writing business plans to explain investments. This is when i started to realize that H-1B is indeed a serious business and I am in trouble. This was exactly what Jay predicted and I did not pay much attention to. Amazing thing is that because of his foresight WE WERE READY and had already done our homework even before filing. Jay had asked me to collect all my work samples, and we provided all my technical writings with a "very" "very" detailed and well written response, arguing that Technical Writers should not be reserved to just engineers writing technical product documentation. Jay went on to research and provided actual data from Bureau of Labor Statistics, and explained how the data was compiled by Labor Department. I will not bore you with the technical stuff. So basically Jay's winning argument was that Labor Department Statistics never intended to confine technical writers to just limited industries. It is applicable to broader category of "Employment Services", and Employment Services include any business that provide any services to clients.
Therefore USCIS CANNOT DENY THE CASE stating that it was not an applicable title. Case was immediately approved withing 3-4 days of submission. This experience taught me a lot about immigration and how technical it can get. Not to mention, Jay said that he will go to battle with USCIS in courts if he had to because USCIS was wrong. He is an expert in the area of immigration specially H-1Bs and is my attorney forever!!

I am a US Citizen and my husband's immigrant visa was denied. He was subjected to a 10 year bar from entering the US because of his prior unlawful stay in the US and entry without inspection. He was stuck in Mexico for a long time while I and kids are living here in California. It was very hard for me to bear the separation and raise the kids by myself. I contacted Jay. Jay explained the issues very well and informed me that it was a very difficult case, because of prior visa violation, illegal entry, and couple of years of unauthorized stay. Jay did not sugar coat or made any false promises, and explained the facts as they were. He filed a hardship waiver on behalf of my husband. He was very detailed in his brief and supporting documents. Jay argued about country conditions in Mexico, hardship for me and my kids to relocate, and several other humanitarian arguments. It took several months, but USCIS finally approved the case. Then Jay helped to schedule interview at Ciudad Juarez consulate. My husband's unlawful presence and illegal entry was forgiven and he was granted an immigrant visa. My husband is going to be here within next two weeks, and our entire family is looking forward to this. We have waited so long, and I cannot express the joy this brings to us. We are very thankful for all the help and guidance Jay has provided for us throughout the case. Jay was very helpful and easy to reach and very good at returning emails and phone calls. I don't know if I could have done this without his help .

I would absolutely recommend Jay Terkiana, for handling most difficult of the cases. He handled my very complicated case and got I-140 approved. I am an international swimmer, and was looking to apply for EB-1 (Extraordinary Ability) green card. I filed I-140 through an attorney who received a request for evidence on my case. The attorney was not very confident in my case. Then I approached Jay Terkiana, who advised me very diligently on what evidence will fulfill the requirements for EB-1 green card under extraordinary ability alien. Jay prepared a very nice response to my RFE, and documented my portfolio and achievements very well. USCIS approved my I-140. I am very happy and looking forward to receive my green card. Jay is really detailed and very thorough in his writing. He knows and understands the issues very well and handles the problems very well.

He did my case very seriously, first list all the required materials I need to prepare, and keep updating the status of my need-to-be-prepared materials, he also keep communicating with me and ask me if I had any questions during the preparation.

Jagbir Singh Terkiana is working with my company helping four of us on the H1B case. Fortunately, we all got approved I have to say this all thanks to Jay. He is extremely detail oriented, responsible and patient. At the first phase, he could explain all the details about application and processing to us, and help us analyze every individual case based on our actual situation. He also could update the information in time, I always could get an emails when my case was received or got approved, he was always the first person who inform me. Jay is the best!

I turned to Jagbir for help after my first H1B transfer petition got denied. I then got an offer from another company but still were very worried about the influence from the previous denial. After reviewing my case, Jagbir helped me with choosing a more suitable title with my new application and looked into every detail in the paperwork to make sure the risk of being denied is reduced to the minimum.

We approached Jay Terkiana to assist our brand new startup company to file an H-1B for our first employee. Initially we thought, Jay's services were expensive. But soon we realized by the amount of time, attention and dedication that he put to our case that he is totally worth it. We were very impressed with his knowledge of immigration law and he explained us in great detail, what challenges startup businesses face when filing H-1Bs. He explained us how USCIS reviews H-1B for a brand new company with zero revenues and educated us on some of the very important requirements that we were not aware of, such as what USCIS considers Employer-Employee Relationship and Right to Control H-1B Applicant's job. Before contacting Jay, we contacted several attorneys. Jay seemed to be on entire another level and knew what he was doing and talking about. He guided us in advance on what USCIS will question and how to be prepared for the same. He explained us how to meet the requirements of "Ability to Pay Wages" when company has just started and what USCIS expects in a business plan for a start-up company. Lot of evidence was provided to prove the existence of a valid and actual job and establishing that the job qualifies as a Bachelor's Degree level job. After filing the initial petition, we waited for the decision. USCIS issued an RFE, raising issues we discussed before hand - "Employer-Employee Relationship", "Ability to Pay", "Bachelor Degree Level Job", "Right to Control", "Availability of sufficient work", "nature of business / office size / future plans, etc.". Thanks to Jay we were ready, and had all the documentation available to assert our position. Those things, that were not available, we provided arguments why it was not available, and established that it is very certain that our startup will be a success and will generate good revenue. The case was approved very quickly under premium processing. He was available over his cell phone throughout the process and spent tremendous amount of time on the strategy, documentations, compliance requirements, etc. We never had to go through any paralegals or clerks or receptionists. He was directly involved with the case.

This is my second time availing immigration service from Jay and this time again, his service has been flawless! Earlier, Jay helped me transition to H4 visa, and now with my H4 EAD. I received my EAD approval today!

Jay is very experienced with L1 Visa application. His work is well organized. The document list is straightforward enough for me to prepare. He reviewed everything I provided and gave helpful suggestions on them. He also kept me informed on all the processes and successfully helped me get the visa.
