    Description:
    Plaintiff was a partner in a real estate investment. Just before the close of escrow on the sale of the property, a dispute arose between the partners and the plaintiff became concerned that he would not recieve his fair share of the sale proceeds. We immediately filed a complaint with lis pendens (to tie up the property pending resolution of the case) and sought an ex parte (emergency) restraining order. As a result, the parties negotiated a resolution of this matter and escrow closed. As a side benefit, we were also able to successfully resolve a separate business dispute involving some of the same defendants.

    Description:
    I represented the defendants in a civil case brought by a mortgage company alleging complex real estate fraud claims. A criminal action, concurrently originated by plaintiff, is still pending in which defendants are represented by separate criminal defense counsel. A mutually acceptable civil settlement was agreed to after a judicial mediation. As part of the civil settlement, I obtained a court order regarding the determination of a good faith settlement, which should assist defendants with the resolution/disposition of the criminal matter.

    Description:
    I represented the plaintiff, a subcontractor who provided and installed custom flooring materials for several custom houses for a general contractor pursuant to written agreements. The defendant contractor breached the written agreements by failing to pay plaintiff. After filing the lawsuit, the defendant agreed to settle the matter. As part of a settlement agreement, the defendant paid the obligation in full and we dismissed the case.

    The tenant of an industrial/R&D property, breached its lease by conducting significant unauthorized alterations and improvements, which were not permited or up to code. We acheived a favorable outcome for landlord by recovering a significant sum at mediation.

    Description:
    I successfully represented a seasoned real estate professional who was an employee of a developer and investor in several of the devloper's data center and hotel projects. Investor alleged that the managing member abused his position to defraud investor of approximately $5,000,000. Developer countered by saying that investor didnt properly meet capital calls and other obligations. After much hard-fought litigation, the matter was settled at mediation. During the course of the battle, my client recovered approximately $4,500,000.00, which was a fantastic outcome as the developer had taken a hard-line position claiming that the client actually owed him over $5,000,000.00.

    Description:
    Successful represention at trial of two defendants, a CSLB licensed contractor and a separate employee/licensed contractor (an RME). Plaintiff, who owned an investment property in Menlo Park, sued them (and several others) in connection with door replacement and trim/millwork services that plaintiff had contracted for at his property, but subsequently cancelled during the installation process. Plaintiff claimed numerous causes of action for fraud, breach of contract, negligence and intentional infliction of emotional harm, alleging that defendants caused him close to $400,000 in damages. After a long bench trial, my clients prevailed and obtained a full defense verdict.
