  • Injured in car accident. I was hurt and had injuries.. The other driver was ticketed for following too closely.

    iF YOU WERE HURT AND HAD INJURIES AND YOUR ATORNEY DOES NOT WANT TO FOLLOW SUIT MEANS HE THINKS YOUR CASE IS NOT THAT STRONG. MAYBE THE ADDED COSTS AND LITIGATION TIME WILL NOT BE SUFFICIENT TO JUSTIFY FILING THE LAWSUIT. BOTTOM LINE TALK TO YOUR ATORNEY ABOIUT THE CASE AND HIS REASONS OR GET ANOTHER ATTORNEY TO LOOK AT IT. ALSO REMEMBER THAT YOUR ATTORNEY IS ENTITLED TO HIS QUANTUM MERUIT OR LIEN FOR HIS TIME INVOLVED IN YOUR CASE. THIS MIGHT MAKE IT VERY DIFFICULT FOR YOU TO GET ANOTHER ATTORNEY. BEST OF LUCK.

    I agree with most of my colleagues. If there is a scintilla of a future conflict, as there is in this case, each party should have its own attorney. Normally, the sister would not have a wrongful death claim which is set by statute, however, if there are special circumstances, if may be possible that she could have a claim thuis the conflict would arise if one attorney were to represent both parties. No waiver would prevent, the second party from being dropped at the last minute. Better to have her own attorney advcise her. Best of luck.

    There are tow issues raised here. One is pointed by mu colleague, i.e. a Formation issue which could render the contract void or voidable and the second is one of capacity. Either one should be ground for further investigation. Hire a local contract or elder law attorney in your city to investigate this case. Best of luck,

  • GEICO has a judgment against me. I won a settlement in a different case. Can GEICO take my settlement if I don't make payments

    I live in MD. My license was suspended because I didn't keep the payment arrangement with GEICO. The settlement I won was in another MVA.

    If Geico has a judgment against you, they can execute the Judgment against any bank account you have or at their election, they could garnish your wages. It is not clear If Geico has both the Judgment and the obligation to pay the settlement from the other state. If Geico has both transactions, then, it is theoretically conceivable that Geico could offset its obligation to pay under your settlement against its judgment. However, if both transactions are entirely unrelated, then the only way they can get to your money is when you deposit your funds in your bank. You should disclose this fact to your atorney right away and make arrangenments to pay your debt. Best of luck.

    iT APPEARS THAT YOU HAVE A POTENTIAL CAUSE OF ACTION. DO YOU KNOW IF THERE WAS AN AUTOPSY? I WOULD BE CURIOUS TO FIND OUT WHAT WAS THE LEVEL OF ALCOHOL IN HIS SYSTEM.
