Description:This case involved a Mam Mayan man whose family was massacred during the Guatemalan civil war. The court was considering a petition for review of the denial of his asylum application. I argued the case before the Ninth Circuit, which granted the petition in a published opinion. The court found that where a family is severely persecuted and there is a close relationship between that persecution and a mother's inability to provide the basic necessities to her child (in this case because the mother was unable to breastfeed due to nutritional deprivation while hiding in a forest), the harms were persecution of the child.
