    You should immediately get a criminal defense lawyer in your area, Denis White in Sacramento, is very good. The lawyer can file a motion, and depending on your status get the property returned or a portion of it. You didn't say if they had a warrant and for what, so you should discuss this with your attorney immediately. Good luck.

    If your son is breaking the law, he is heading for criminal action against him. He will need a defense lawyer. If he is the victim of someone else attacking him, he will need a civil lawyer if he is injured. That may not be a viable action if he started the action.. Your question is too vague because you do not explain what is happening. You should contact a local lawyer with specific information.

    The answer to your question depends on whether or not you were given deferred prosecution with 6 months of probation. If you were given deferred prosecution, then at the end of the prosecution, as long as you stayed out of trouble, your case gets dismissed. On the other hand, if you were convicted and given 6 months of probation, it will stand. However, if you were convicted of battery, the probation is usually 3 years, so you need to look at what the judge ordered. Check with the lawyer...

    You have a warrant for fleeing from your program. Not only did you not serve your time imposed, but by fleeing, you have added new charges. As you were a juvenile, you need to get back in court before you turn 23 to keep that status. Your lawyer may be able to assist you with the new charges for fleeing, but you need to get a lawyer and turn yourself in now. The longer you wait, the tougher this going to harder to resolve. If you are stopped and brought in, it will be worse. Get a lawyer...

    At the end or your time, you will be turned over to ICE. You should get an immigration lawyer while you are serving your time to see if there is anyway to avoid the deportation.

    You cannot be violated for something expunged. You need to go back to the attorney that handled this case, and have him explain what actually happened.

    He does get half time, so yes he gets out early; that is less time than the full sentence under AB109, less the credit for the 77 days.

    There appears to be two problems here. First, did he ever resolve the DUI? Did he get a punishment in court and do what the court told him to, or did he just leave without going to court. If he just left, then there is a warrant which can add to the DUI problem. Second, he cannot get a green card while on probation, so you need a criminal and immigration attorney, and now. You do not want him picked up without this having been taken care of.

    I would be going to AA everyday, and get into an out patient alcohol and drug program, and bring witnesses to your hearing that the beer was not your beer, and that none of it was open. This will of course depend on the judge that you have, but if fair. You at least have a shot at staying out of jail.
