It definitely makes a difference to go with an attorney with experience in personal injury cases, especially an attorney with experience in traumatic brain injury cases. I would seriously consider discussing your case with your attorney since from what you have told us, he may not have the necessary experience and funding to fight for you on this case. He can refer the case to a personal injury attorney in your area or even co-counsel with another office. Either way, you need to get an...

First, slip and fall cases can be difficult cases because most of the time they are fought tooth and nail by the store itself or its insurance company. The main hurdle in proving your case in the majority of these cases is proving the store is responsible for your fall. Basically, proving who owned, controlled, or maintained the property where the slip and fall occurred, and whether that party had notice of the condition that caused you to fall. (NOTE: There are more elements to prove but...

Any time that you are involved in any type of incident that involves an injury, you should immediately talk to a personal injury attorney, preferably from your home area. Our office for example provides free consultations in personal injury cases where we meet with prospective clients, evaluate their case, and map out possible courses of action that the client can take. Even if the attorney chooses not to accept your case, at the very least you will have had a face to face conversation with...

I would have to make many assumptions before answering this question. If you are represented by counsel, obviously they can inform you on what to do. If you are representing yourself, you can either mail, e-mail, or fax over a settlement offer. I would speak to opposing counsel and see what method of service they accept. Make sure that you provide evidence that supports your settlement offer, including any relevant records, bills, etc. If you have not already done so, I would speak to a...

I always advise anyone who is presented with a legal document that may affect their rights to consult an attorney who can review the document and advise the person what it means and what they are signing away. If you have any doubts about the document or trouble understanding what it says, you may want to have an attorney look over the document. All this being said, it seems like your boss took good care of you after this dog bite. I have not seen the document itself or know what it says,...

This is a common tactic used by insurance companies. In California, you have two years to file a lawsuit no matter what the insurance company does with the claim. Although I do not know the facts and circumstances surrounding your claim, I would recommend meeting with a personal injury attorney to discuss your options. If you do sue, I would sue the owner and the driver.

I am sorry to hear about your car accident. Unfortunately, it is not uncommon for drivers to consciously make the poor decision of driving while under the influence of alcohol and drugs. There are multitudes of accidents that occur because a person used poor judgment when they decided to get on the road while intoxicated. To answer your question, you definitely need a lawyer on your case. Cases involving drunk defendants sometimes have a criminal component where you have to wait until...

I would consider looking into the lawyer referral network of the Sacramento County Bar Association or the Volunteer Legal Services Program in Sacramento to help you with this issue. You will need to provide more facts regarding the circumstances surrounding this collections case.

This is a very difficult question to answer without having an opportunity to review the facts and circumstances surrounding the incident itself, as well as a review of your medical records. In addition, it would be helpful to know the diagnosis made by your treating doctors and psychiatrist and their opinions regarding your need for future medical care. This incident sounds traumatic and I believe that you would greatly benefit by consulting with a personal injury attorney in your area. Most...

I think it is important that you speak to a personal injury attorney in your local area about your case. When it comes to seeking benefits under your Uninsured Motorist policy, you would benefit from meeting with an attorney for a free consultation to advise you and give you guidance on your case. Insurance companies must give as much consideration to your welfare as they do to their own interests in UM cases. Therefore, your insurance company may be setting themselves up for bad faith if...
