  • My wife was found to be at fault hitting a pedestrian, she is being sued for $100,000.00.

What type of lawyer should she be seeking to obtain?

    Ilya’s Answer

The first question would be whether your wife had any motor vehicle insurance at the time of the incident. If she did, an attorney will be appointed to you by your insurance company. Contact your insurance company and notify them that your wife was involved in a motor vehicle collision and they will appoint you an attorney.

If you did not have applicable insurance at the time of the collision, you will have to find an attorney familiar with personal injury type cases that can defend you in the lawsuit. There are local business attorneys that work for insurance companies that could take your case on an hourly rate. I would need more information about your particular situation to make any other suggestions.

    Good luck.

    Ilya’s Answer

You would be best suited to meet and speak to a personal injury attorney that specializes in medical malpractice cases in your local area. Most personal injury attorneys offer free consultations and will review your medical records and any other relevant paperwork to determine if the surgeon's work falls below the professional standard of care. If it does, then you may be entitled to compensation. Call to meet with an attorney sooner rather than later.

    Good luck.

  • I'm making a settlement offer to oc, do I have to serve it on them, or can i just email the offer?

I'm trying to settle a personal injury accident, and we are in litigation.

    Ilya’s Answer

I would have to make many assumptions before answering this question. If you are represented by counsel, obviously they can inform you on what to do. If you are representing yourself, you can either mail, e-mail, or fax over a settlement offer. I would speak to opposing counsel and see what method of service they accept. Make sure that you provide evidence that supports your settlement offer, including any relevant records, bills, etc. If you have not already done so, I would speak to a personal injury attorney in your area regarding the potential value of your case. They can advise you what documentation to provide and how to organize your settlement offer. There are many different avenues you can pursue when making settlement offers and they all depend on the facts and circumstances of your case.

    Good luck.

  • Who do I sue?? Driver or owner???

    Ilya’s Answer

This is a common tactic used by insurance companies. In California, you have two years to file a lawsuit no matter what the insurance company does with the claim. Although I do not know the facts and circumstances surrounding your claim, I would recommend meeting with a personal injury attorney to discuss your options. If you do sue, I would sue the owner and the driver.

I would consider looking into the lawyer referral network of the Sacramento County Bar Association or the Volunteer Legal Services Program in Sacramento to help you with this issue. You will need to provide more facts regarding the circumstances surrounding this collections case.

  • Auto accident, hit by drunk driver who ran a red light, do I need a lawyer?

I was making a left turn in a green arrow and got hit by a person who ran a red light. Police came and performed test on him and he was intoxicated and hand cuffed into police car. My car looked really bad, but may or may not qualified to be tot...

    Ilya’s Answer

I am sorry to hear about your car accident. Unfortunately, it is not uncommon for drivers to consciously make the poor decision of driving while under the influence of alcohol and drugs. There are multitudes of accidents that occur because a person used poor judgment when they decided to get on the road while intoxicated.

To answer your question, you definitely need a lawyer on your case. Cases involving drunk defendants sometimes have a criminal component where you have to wait until the criminal case concludes before proceeding against the defendant in a civil lawsuit. In addition, an investigation into the defendant's level of intoxication and supporting evidence and documentation is required in cases like this. Hiring an attorney to help you navigate this often complex area will help you maximize your recovery.

Lastly, you should be able to handle the property damage claim yourself. Most attorney do not (and should not) charge a fee on your property damage claim since you can usually work it out on your own.

I would recommend consulting with a personal injury attorney in your area for a free consultation.

    Good luck.

  • Do I have a case?

About 5-6 years ago, my mom had this cough for a while that wouldn't go away so I took her to see her doctor(county doc), and he said she was fine. She started coughing up blood really bad so I called 911.They took xray and said she had pneumonia ...

    Ilya’s Answer

I am very sorry to hear about your mother's passing. To answer your question, medical malpractice cases are very complicated and are dependent on a number of factors, one of which includes notice of the condition that your mother suffered from and whether the doctors' actions fell below the standard of care when they examined your mother 5-6 years ago and did not notify her of the TB Meningitis. You may have a statute of limitations problem, depending on when your mother discovered that she had TB Meningitis. The only way to really know whether you have a case is to consult with a personal injury attorney in your area who can look over your mother's medical records.

    Good luck.

Had accident with large truck. 100% truckers fault. Extended poles tore roof off my car starting at drivers side. I am 72 years old. My injuries are sore neck - getting acupuncture. Do not expect medical bills to exceed $3000 - $5000. My big...

    Ilya’s Answer

This is a very difficult question to answer without having an opportunity to review the facts and circumstances surrounding the incident itself, as well as a review of your medical records. In addition, it would be helpful to know the diagnosis made by your treating doctors and psychiatrist and their opinions regarding your need for future medical care. This incident sounds traumatic and I believe that you would greatly benefit by consulting with a personal injury attorney in your area. Most attorneys charge a free consultation and will be able to give you advice tailored specifically to your case and may even be able to advise you to pursue this case on your own.

If you do decide to pursue this case on your own, you should be aware that an insurance company is unlikely to treat you fairly without an attorney and you will likely not be able to maximize the value of your case. I would recommend seeking the advice of a personal injury attorney in your area to help you with your case.

    Good luck.

  • Can you sue your insurance company for not sending you a cancellation notice prior to cancelling?

    Ilya’s Answer

An insurance company has a duty to give you proper notice prior to cancelling your policy. I would request the documentation evidencing that you were given notice from the insurance company before they cancelled your policy. I would also consult with an insurance litigation attorney to determine whether your insurance company followed the appropriate procedure when they cancelled your policy.

    Ilya’s Answer

I am very sorry to hear about your loss.

Unfortunately, any time there is an accident involving a death, there will be a lengthy investigation into the parties, witnesses, the way the accident occurred, determination of fault, and other factors that go into the investigation. The District Attorney then potentially reviews the case to determine if there is any criminal liability. If there is criminal liability, then the District Attorney's Office will prosecute the case and usually will not provide any part of their files until the case concludes.

Lastly, if you are not married, it is unlikely that you will be able to obtain the police report. I would work with your boyfriend's family and ask the police department if the matter was sent to the District Attorney and try to make contact with someone in that office. Otherwise, your boyfriend's family will have to hire a personal injury attorney and have them check on the status of the report.

    Good luck.
