    Jason’s Answer

You may simply check with the court house. Many courts have this information on-line but other courts do not. Your court house should have a public viewing room where you will be able to view your file. Simply request it at the window and all information pertaining to the legal proceedings will be in there.

There are labor laws in every state to protect employees. This is a violation of labor law. Contact your employer and kindly voice your frustrations at what has occurred. Inform them that you will be consulting with a labor lawyer in order to have the situation remedied.

    Jason’s Answer

If your son was acting in self-defense, this is something that should be addressed. Were there witnesses to the fight? If so, what did they see? Who will they make a statement for?

The law of assault is the threat of violence caused by an immediate show of force. Here, it sounds based on what you wrote that this was an assault.

    Jason’s Answer

You should consult with an attorney as soon as possible. Personal injury claims are subject to a strict statute of limitations.

Additionally, permises liability cases tend to be some of the hardest cases. I do not believe that these cases should be handled by a layperson. You need to prove notice and duty as to Costco. An attorney is much better suited to doing that than you,

These questions are generally difficult to answer. You did not provide enough information. In order to estimate, we would need to know the total medical bills and the treatment received. Were there any complications as a result of the injury? Did you have surgery? Did you miss work?

The person in the best situation to answer this question is your attorney. He knows the facts better than anyone else.

  • What recourse is there if an attorney fails to uphold a lien?

As a medical provider, we often see personal injury patients and always have the patient and their attorney endorse the lien, promising to withhold from the settlement our fees. Lately I've had a few attorneys fail to do this and tell me the case...

    Jason’s Answer

You have recourse against the attorney. An attorney has fiduciary duty to his client and to the lien holder. If the attorney fails to honor the lien he has signed, you may request payment. If the amount is below $ 7,500.00, you may take him or her to small claims court.

    Jason’s Answer

This situation sounds a little more complicated than a message board answer. There may be a cause of action under FMLA but more facts are needed.

In addition, there is a labor code violation for the manager clocking you out. You should consult with a labor lawyer near you. Many provide free consultations.

    Jason’s Answer

Generally, as a tenant, you are requried to vacate your premises in broom clean condition. Th landlord is allowed to deduct for any necessary repairs but not for normal wear and tear. He must provide an accounting to you and back it up with receipt.

If you are unhappy, your only recourse may be to sue him in small claims court. If you when, you will receive some of your money back plus damages on top. The landlord will then have to pay your court costs.
