Description:Being pulled over and arrested for driving under the influence is serious enough. Getting into a car accident when you are over .08 BAC and being arrested for DUI with Injury is extremely serious and can lead to a felony conviction. It comes to a surprise to a lot of people (and inexperienced lawyers) that these charges are a lot more difficult for the prosecution to prove than a regular DUI. The fact that a defendant was under the influence and was in a car accident that resulted in someone being injured is not enough. A charge of VC 23153 must be supported by evidence that defendant committed an illegal act or failed to perform a lawful duty; and that illegal act or failure to act was a cause of bodily injury to a victim. In 2013 alone, Mr. Flores has secured two standard misdemeanor DUI convictions for clients based primarily on disputes of liability. Liability for causing the accident was disputed in both cases and independent witnesses supported that the other driver, while presumably sober, caused the accident by his/her own poor driving.
