    Well, I would assume there is an ongoing divorce proceeding taking place. Also, a question - your own payment plan - is it a written agreement? (I would hope so) - because absent such an agreement or a court order it will be that much more difficult to try and get the Father to pay.

    The fact that you are on good terms is good news - so, I would probably try to get that agreement in writing (at least.)

    One idea is to call your local Bar Association and inquire as to whether they could refer you to an attorney handling cases on a reduced fee basis (we do that here in San Francisco.)

    Most states have some set guidelines for child support. In CA, for example, the amount of child support, depends, among other things, on parent’s earnings and the time each parent spends with a child. An attorney practicing in your state would be the best person to turn to in this situation. It is also not very clear whether you are going to court as part of the divorce/legal separation proceedings. It looks like your hearing is tomorrow, in which case, do your best, and present the facts as you know them — what was the agreement between you and your spouse, what was the payment schedule like, how much he actually paid you and also describe your financial situation.     At least do not ignore it. Without knowing much detail of your case, it is difficult to help you. However, one thing you should do is to file an answer to the complaint and you can also file a motion to change venue so that the case would be moved to the place of your residence. Unless the other party has a reason to sue you in another state, you should be able to win on this motion.

    Another recommendation is to check with your local Legal Aid services. You might qualify for some kind of free legal advice in case you cannot afford to hire an attorney. But I would definitely recommend contacting one.
