    There are cases on point on this issue....you should surely consult with a DUI specialist. Was that the only probable cause for the stop?

    Call a local attorney and set up a DMV hearing. The great thing about those hearings is that if you subpoena the cop you get to cross examine him without another attorney (DA) there.

    Sometimes Federal defenders have way bigger case loads and less time for each client so meet with your attorney and see how you feel.

    The DA has 1 year to file on a Misdo and 3 years on a Felony...so you must keep calling to see if charges have been filed yet. Just call the DA's office and give them your first name, last name DOB. Scotty

    Sadly you can't move the venue from one case to the other city...you basically have two cases in two cities to deal with. Perhaps see if 1 attorney can do both cases.

    It is possible, the best thing to do is consult with a DUI attorney. Sometimes it's possible to poke enough holes in their case such that they will offer you a wet or dry reckless.

    Locally it's called a Penal Code 1203.4 to eliminate a conviction or a Motion of Factual Innocence to erase an arrest where no charges were ever filed.
