    The fine does seem high. I would go to court and ask the judge to consider a reduction in fine amount based on equitable factors like maybe you have a clean driving record and are the sole provider for your family. Also, some counties allow you to do a portion of the fine as community service hours. Good luck.

  • Do I need an attorney to help drop a DUI charge that was not filed before my court date?

    The short answer is probably not. With a BAC of .19, the DA will most likely file unless there are evidence issues. Also, it is common to go to court on the citation day and not have charges filed, that is why the DA gets up to a year to file a DUI because there are a lot of them and they are so common. Just keep calling the DA's Office and the Courthouse to see if charges were filed, if you do not receive something in the mail. Good luck.

    Yes, there is a 2 day deadline to file PC 1050 motions for continuances. However, it seems like, here, the DA has filed their own motions to continue, so they should play fair and allow you a continuance. Just politely point out that the court gave the DA 3 prior continuances and you are just asking for one. Good luck.

    my husband has a Further court date in oct for this, but is it just a ticket and then a release or possible jail time as well? On probation, violated twice already i believe and now this.

    It is just a ticket to appear in court, which if he does not, they will issue a warrant for him. I think they will just give him some straight jail time at this point for his continued drug use. It may even be better for him, that way he is no longer on probation and subject to searches and seizures and can be more free from law enforcement contact. Good luck.

    The best advice I can give you is that it may be possible for him to run his current California sentence concurrent with his Pennsylvania cases, however, you should speak with a local attorney who knows the law and can give you much needed advice. Good luck.

    Given the nature of the offense, your age and lack of prior criminal history, it probably will not be but a few days in jail, which most counties allow you to do on some alternative program - like cleaning up the roads, a fine and probation. What will hurt you is having this on your record and prospective employers will look down on a prior theft offense as a bad thing. However, the good news is that your offense will be expungeable after you have been on probation for a little while, and you will be able to remove the offense from your employment record.     You should contact the local police department that has your vehicle and ask them why it is still being held there? You can also ask the records department of that police department to see if they will tell you who the name of the officer that took your vehicle from your premises, and you can try speaking with him or her directly.     Yes, you need to keep in contact with the court house and the DA's Office about any possible filing of charges. Also, you can call the jail where you were booked and ask for booking/release paper work. I just had a client with the same issue and she went to the jail and they gave her a copy of the document they claim to have given her after her arrest and release. I would suggest you do the same.
