  • What advice would you give a client who works around children (i.e. teacher, coach) and is a subject of an investigation?

I am neither under investigation nor do I work around kids. I've always been curious as to what criminal lawyers advise or what have you advised in the past to clients who are under investigation for "non-touching" sexual crimes (i.e. porn) when t...

    Greg’s Answer

Depends on the facts of the case. Other than "don't talk to the police" everything is pretty fact specific.

  • Have you been convicted or plead guilty or no contest to any crime or been released from prison in the last seven years? *

I was asked this question on a background check. Back in 2012 I charged with a misdemeanor but since I was 18 and had no prior offense I was able to participate in diversion. The case was then dismissed. So what is the correct answer for this que...

  • How come some people are arrested after a search warrant is executed and others are not?

I always thought that if law enforcement executes a search warrant and they found evidence of a crime (i.e. drugs, porn), that they arrest people at that moment.

    Greg’s Answer

Sometimes they want more evidence (or to anaylize what they have) before mKung an arrest that starts a clock to trial.

    Greg’s Answer

"Obey all federal state and local laws" was almost certainly a term of your probation. Marijuana posession is illegal under federal law. Will you be violated for that?Probably not. Could you be? Yes.

I'm curious, was your probation transferred when you moved out here?

Was it a DUI or similar? If so, there may be a dmv record separate from the criminal conviction.

  • Is it illegal to tip a public defender to get them to work more diligently on your case?

I know public defenders are paid by the state but can you gift them money after each hearing to make them work harder on your case?

    Greg’s Answer

Illegal? No. It would be unethical, however, for them to accept, and most would be insulted by your assumption that they needed to be bribed to do their job.

    Greg’s Answer

I don't mean this answer at all in a joking or dismissive way, but your question is WAY beyond the scope of this forum. It's like asking a cardiologist "what do I do about a blocked artery?" The answer is going to be "you come in to my office, I get more info, and then I do a list of technical things to save your life that is too long and complicated to explain to you in an email."

  • On an all felony case for 5 counts of poss/controlled substance 5 for poss/controlled substance f/sale 5 counts of transport

And 1count for gang inhancemen. They say they have audio n video of the transaction with me and the csi. So I wanted to know if I have my first court date on May 5. how early can I get the discovery. So I can get well prepared for my case. Thanks

    Greg’s Answer

Depends on the prosecutor's office and the police agency. Technically once your lawyers makes a demand they are supposed to turn it over within ten days, but it often takes weeks longer and courts let them get away with it. Of course I am assuming you are not actually trying to pro per litigate a strike offense and you do HAVE an attorney and you want THEM to be prepared for your case. You really have no chance of doing this correctly on your own. It would be like performing amature surgery. Life threatening surgery.
