  • Will probation arrest me?

Probation searched my apartment this morning and found empty cans of alcohol in a cabinet. I said I didn't know they were there when they asked me who's alcohol it was. I live with my girlfriend and 3 kids. Probation officer took pics but did not ...

Could go either way. This isn't really a legal question. Can they arrest you? Yes. Will they? No one can say. The fact that they didn't take you in right there bodes well. It is also possible that the evidence shows something other than a violation by you.

    Greg’s Answer

Sounds to me like his own family members could clear him if they were man enough to admit what they did and tell the authorities that he wasn't involved. Other than that, there isn't much a non-lawyer can do to help.

There isn't any magic. You need to have an attorney look at your whole case and history.

  • DUI, how and at which point do I need to ask for a public defender ?

DUI-first time-- I can't afford a lawyer. My court date is in 3 weeks. Exactly at which point and how do I ask for a public defender. I understand also, I have to notify DMV in 10 days from the day of my arrest but I am eligible to ask for a hea...

    Greg’s Answer

You will be asked by the court if you can afford to hire a lawyer. If the answer is no, say no. If the answer is yes, you don't qualify to have a public defender appointed.
The DMV will suspend your license unless you request a hearing. Even if you qualify for the assistance of the public defender's office, they don't usually help with this. The DMV hearing is separate from the criminal matter. It is done over the phone or at a dmv office, not in court.

  • How do you avoid being arrested if you have awarrant for no show to court , but have new date and have another court case before

i missed my prop 47 court review and have a warrant but i was put back on the calandar with a new court date by my public defender, i have another case of misdameanor child endangerment and have a court review coming up before my drug court review...

    Greg’s Answer

There are numerous things you say here that cannot be correct. First: A warrant cannot issued for failure to appear on a Prop 47 petition. A prop 47 petition is a defendant request, and failure appear will only result in a denial of the request. Second: A case of "misdemeanor" child endangerment would not be heard in a family law court. The fact that it is a misdemeanor case means it is a criminal matter. SO... Assuming that what really happened here is that you have a warrant for failing to meet drug court terms and you have another criminal case comming up, it is a very real possibility that you will be arrested on the warrant. If you cannot clear the drug court warrant by making yourself a walk-in before the date set for the child abuse case, I agree that you can only hope for the best, and if possible, contact a bail bondsman.

It's hard to say, but probably yes. Your attorney should have requested an extension of the TRO every time you appeared in court.

No one but the restrained party may violate a restraining order. That being said it is illegal to make harassing phone calls even without a restraining order. CPS can always investigate any allegations of wrongdoing.

    Greg’s Answer

Once a criminal case is filed, only the prosecuting agency (usually the District Attorney's Office) can drop the charges. You may be able to convince them to do that, HOWEVER, I strongly suggest you NOT talk to any member of law enforcement. You should either contact through your boyfriends attorney, or through an attorney of your own. There are a number of complex reasons for this, but suffice it to say that not contacting them directly protects both you and your boyfriend.
