    I have an open case for DV with GBI and posted bail. 10 days later I was involved in an accident. I woke up in the hospital to be arrested by a police officer. Later, I found out I was in involved in a DUI that caused a GBI.

    The primary problem you have is that if you appear in one county's court they at supposed to arrest you on the other county's warrant. Would that actually happen? Probably not. To be sure you should try to have an attorney (or two depending on the distance between the two courts) appear on your behalf to get both warrants recalled. Eventually you will want to present medical records and a signed affidavit to both courts of what you just told us. DO NOT do this without talking an attorney about other options given ALL the facts of your two cases first.

  • Can my friend report a sexual assault charge?

    My friend just found out his nice was sexually assaulted by her dad about 3 years ago, she's an adult now and seems to be afraid to report it. He wants to know if he can make the report himself regardless of the victims approval.

    Yes. The victim doesn't need to report the crime (or else there would be no murder prosecutions). He can't make her cooperate with the police however, and they will need her cooperation to make a case.

    The information provided is far too vague to give you a quick response over email. You need to talk face to face with a divorce lawyer. If you can't afford a divorce lawyer look to your counties family law facilitator for advice.

    Are you guilty of robbery? No. Can innocent people get convicted? Yes. Will that happen to you? Impossible to say without more information. You should certainly (through a lawyer) offer to roll on your ex-friend as a sign of good faith.

  • Do I need an attorney for DUI expungement?

    I got a DUI 6 years ago in Sacramento, California. I currently live in Oregon and looking into getting my DUI expunged. Looking into how to start the process.

    Do you have to get a lawyer? No. But you may want to to. First, the expungement needs to be filed in the same county where the conviction was entered. Second, an expungement can be both filed and litigated without you needing to appear.
    What this means if that you either have to write the motion yourself (not that difficult, use Judicial Councel forms 181 and 182) and then go to Sacramento to file it, and again (maybe) to appear in court, or you can hire a Sacramenro lawyer for about a thousand dollars to do it for you.

    Almost certainly no. He almost certainly "waived time" meaning he waived his right to a speedy trial. This is routine when plea bargains result in delays agreed to by both sides.
