    You are entitled to a copy of your file. You can also view the docket of the court file. The answer is certain to be there. However, it is a sad state of affairs if you don't trust the word of your lawyer. You should attempt to reconcile the distrust and mend the attorney client releationship. If you cannot trust your attorney, then you should change lawyers to one you can trust and have faith in.

    Your friend has 10 days from the date of issuance to request an APS hearing. It is civil in nature so there is no free lawyer. Your friend should hire a lawyer to represent him/her at the DMV. The lawyer retained must be well versed in DUI and DMV matters. Feel free to have your friend call me if s/he has any further questions.

    Blood Alcohol levels are constantly changing. They go up in a non liniar progression and then you get to your plateau which is short lived (usually 5 - 15 minutes) and then they go down in a liniar progression at an average rate of 0.015% per hour. It is generally impossible to plot a BAC to an earlier time from a single chemical test result. The attempt to do so is called "Retrograde Extrapolation" and is "A very dubious practice" according to Dr. Allen W. Jones, one of the leading experts on the topic. Dr. Kurt M. Dubowski agrees with him, and both gentlemen have published this opinion several times in peer reviewed works.

    I was charged with a DUI, reckless driving but were dismissed. If I am applying for a driving job should I disclose this even if they were dismissed and there is no conviction? Please advice.

    Prospective employers cannot ask about arrests, only convictions. You do not need to disclose an arrest of a matter that was dismissed. You should consider making a motion to seal the record and/or for a determination of factual innosence

    With a good lawyer he can expect probation with credit for time served.

    When your brother goes to court on his very first court date, he can make application for a court appointed attorney. However, he has only 10 days from the date of arrest to request a hearing with the DMV, and the Public Defender will not help him with that case. He would be well advised to contact and retain an experienced Bay area DUI attorney.

    Hire an attorney who is practices regularly in the court where your case is filed and have that lawyer go back to court for you to clean up your case and recall the warrant. This will be the best way for you to avoid getting arrested and jailed.
