    I agree with my colleagues. I would add that you can also predict WHEN the suspension will take place. Look at your expiration date on your California license. When it is time for you to renew, bingo. To avoid the suspension and points increasing your rates, you need a lawyer here in CA to do a writ of mandate.     It sounds like he has 3 DUI convictions and this new case is just driving on a suspended license. If that is correct, then he could be INITIALLY looking at as little as 10 days custody (which he may be allowed to serve as cal-trans, community service, or other alternative). But he could have probation violations on each of the DUI's which could mean more custody time. If he has prior arrests for driving on a suspended license, he could be facing a minumum of 30 days custody. There are a lot of variables here. He should talk to a DUI attorney immediately.

    You are entitled to a restricted license if you are enrolled and have the IID installed. If you get different answers than that - they are wrong.

    If the HI court convicts you, and CA DMV finds out (an it will - it's just a matter of time as mr. Fremont suggested), then your CA privilege will be suspended for 6 months - just like a conviction here in CA. However, there is another suspension possible. If the HI MVLD administratively suspends Your driving privilege or HI license, and CA DMV finds out (it most likely will find out), CA DMV will suspend your CA license until the HI MVLD clears the suspension in HI. You may be able to avoid some or all of this by forcing the CA DMV to remove the HI conviction from your CA record once it shows up. It is done by filing a writ of mandate under CCP1085. You should call an attorney to discuss. Look up the attorney you want to call by finding his profile on AVVO.

    I have handled many cases like this. You should call an attorney that has done cases like this. AVVO rules prevent me from advising you to call me. Find an attorney qualified and experienced in these matters and discuss with him immediately. If you live in long beach, your case would be filed in downtown LA where I have been many many times on similar cases.

    You may apply for a PD and if you qualify, the court will appoint one. I have to mention that you are mistaken about the minimum penalty, which is 120 days, not 90 for a 3rd. You could be sentenced to much more time up to one year on this case, In addition to any time you could receive for probation violations. All of that may be meaningless if your case is in LA County - Because typically inmates serve one 10th of their actual sentence.

    As things are now, no. However, you may be able to have the suspension put on hold if you file a petition for writ of mandate and immediately follow that with an ex parte application for a stay under Ccp 1094.5.

    I have seen this many times. It actually happens about 5000 times every year. Unfortunately, most people just do what the DMV says without a fight. Others, research ad reach out as you have done and discover there is another way. However, it does usually require hiring an experienced DUI/DMV attorney that has experience filing writs. Me, and a few others do these regularly. Very few do them in San Diego regularly, such as myself. The proper place to file it is in the county you live. Call an attorney to get more specific information. I am prohibited by AVVO rules from directly suggesting that you call me. You are not prohibited from calling ANY lawyer of your choice.

    As an experienced Orange County DUI attorney, I can tell you that it is possible to have this new case treated as a first offense. Your chances of doing so greatly increase by hiring an expert DUI attorney. Get a free consult from one, to explain what factors would be legally considered by the judge. If you get answers you understand from someone that knows what they are doing, hire him. Find someone that practices in Orange County regularly, who knows which judges and prosecutors are best to deal with.

    You can call the DMV as many of my colleagues suggest. THEN, after getting no help and different answers from several people, call an attorney with specialize knowledge on this specific topic - out of state DUI conviction causing suspension in CA. There are many DUI attorneys. Only a handful know how to handle this particular situation, and even fewer that do it regularly in LA county. I am prevented by AVVO from offering my services directly.
