  • I'm going through debt consolidation,I have a auto loan with the same bank as my loan, can I close my account there and pay them

Every month by brining it in to the bank,I was told that they can take my car from me. Is that true, wouldn't be in their best interest to let me continue to pay the loan?

    Seyed’s Answer

Counsel are correct. It does depend. I have had a lot of cases where the bank has pretended to have consent to pull from one account to pay for debt on another account when in fact they did not. These are good cases and you very well may have a case. Feel free to call my offices for free consult

It depends on statute of limitations for breach of contract in AZ. Also do not make payments on debts that are old that you have not made payments on for a long time as payment an reactivate the statute of limitations. You need to speak to a consumer attorney before you do anything and to really work out your options.
