  • Rear ended on fwy. car that hit me driver not insured on car but car was insured. I have no fault insurance $100/300K.

Lots of ' hard injuries', surgery. Should I go after the car owners insurance or does my insurance take care of settlement for damages? Can you get more then the$100,000 from your own insurance, does it go over to the $300,000 for the occurrence ...

    William’s Answer

You say you have lots of "hard injuries" and surgery from this accident. If so, I would not recommend you try and handle a case like this one without the help of an experienced personal injury attorney. This is complicated by the fact that the driver was not insured. You do have options with your own insurance and the car owner's insurance, but this is something I would leave to a professional attorney. A lawyer is a trained negotiator and knows the ins and outs of these types of cases. I highly recommend you interview a few lawyers here on AVVO who are licensed in California. They offer free consultations and most attorneys work for a percentage of the settlement so there is no money up front or paid by the client. I wish you all the best.

Many people don't realize they can suffer a traumatic brain injury in a car accident even when there has been no head impact. Indeed, the symptoms often show up later when the victim can't remember names or events as well. It's important to see a doctor and treat this type of injury soon after a collision. You need a California-licensed attorney who specializes in brain injury cases. I hope this is helpful.

There are many factors involved in slip and fall cases. Contact any California licensed personal injury lawyer and give the full details about what happened including what type of shoes you were wearing, the type of floor you slipped on, whether you have photographs or made a report at the time of the accident and what treatment is needed. All the best and hope you feel better soon.

This is why it's important to have uninsured/underinsured motorist coverage on your own policy. Make a claim with your insurance company.

Anyone who is injured in a slip and fall type of accident should first consult with a personal injury attorney before speaking with insurance representatives. Time is of the essence so do not delay or you could weaken your case. Most of us offer free consultations based on the specific facts of your case. Hope you are feeling better.

  • I was at a indian casino in california and slipped on a wet floor. I twisted my knee and injured my wrist, back and shoulder.

Went to the er that night. diagnosed with a sprained knee. I have a witness who saw me fall . Do i have a case?

    William’s Answer

First of all, I hope you are feeling better and have followed up with a doctor. I would need some more information to comment on the merits of your case. For example, what type of shoes were you wearing, did you take any photographs of the scene, what was the floor surface you slipped on and the substance and how serious is the knee injury. You could have a case, but more information is necessary to advise you on this potential case.

Since you were at fault for the crash it would be wise to pay. If there are no injuries, I assume the damage may be minimal and paid over time could be kept in your budget. If the amount is substantial and there are injuries, you may wish to contact an attorney to help negotiate a settlement within your means. I'm sorry you are in this situation and I hope that you go out and get some basic coverage to protect you in the future. Car insurance protects you and your passengers as well as others.

  • Is foreign national who slipped and fell at the US airport responsible for medical expenses incurred in the accident?

Foreign national on a valid tourist visa slipped and fell at the airport in California. Port authorities insisted that he is seen by a physician and the passenger was transported to local medical center but was released the same day. Over 10K of ...

    William’s Answer

The person responsible for the accident is the one who is at fault for the accident. If there was a dangerous condition that caused the fall such as a spilled substance, a broken handrail, etc., the airport may be held liable. If the person tripped and fell on their own -- it's likely not going to be a case. A personal injury attorney who specializes in this type of accident may assist you and typically they work on a contingency-fee basis. Hope this is helpful.
