  • Is this defamation? -- accused of stealing, when i did not.

    I was accused of stealing in the workplace ('m totally innocent), and, as such, my employers terminated my contract -- I did not steal, and my boss accused me of doing so. Is this actionable defamation of character? -- I did NOT steal.

    As you describe it, it appears to be defamation. But further facts are required, including what specifically your boss said, how and where he/she said it, who else (if anyone?) heard what your boss said about you, and other such details.     It all depends on whether in Louisiana parties are entitled to amend once as a matter of right, as they are in, for example, California. But if a motion is required to file just a first amended complaint, and the defendant answered the first amended complaint, it would appear that whether or not plaintiff could amend his/her complaint is now a moot issue. But this is an interesting question, as defendant may have waived any objection to the amended complaint while the plaintiff may not have obtained the necessary court approval for the same amended complaint. At this point, just to clarify where things stand, for the benefit of both sides, the parties may want to prepare a Stipulation and Order as to the viability of both the amended complaint and the answer to it. Great question.

    Generally mail service is allowed, but often overnight or personal delivery is required depending on the due date of the document. I would recommend that you either contact local counsel or review the Nassau County rules of civil procedure.

    You will need to explain, in detail, how and why you became ill on Tuesday and were unable to go to Court but could go to Court the next day. Be specific as to your malady on Tuesday and, the Court will likely ask you, how you so quickly healed and were able to come on Wednesday. Be ready for these questions and answer them truthfully when you have your hearing.

    I would suggest that you hire a local paralegal familiar with subpoenas to assist you in this matter. It would appear to be money well spent, and less than it would cost to retain an attorney for the same task. Paralegals are generally very familiar and expert in preparation and service of subpoenas. Many attorneys would be lost without them!
